ORDINANCE NO. BL2016-262

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and easement and to accept new sewer main and easement for properties located at 800 and 802 Marquette Drive (MWS Project No. 16-SG-0059 and Proposal No. 2016M-021ES-001).

WHEREAS, the abandonment of approximately 133 linear feet of existing eight inch sewer main and easement and the acceptance of approximately 302 linear feet of eight inch sewer main and easement for properties located at 800 and 802 Marquette Drive are needed to construct project number 16-SG-0059; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-021ES-001 on April 22, 2016, for the abandonment and acceptance of said sewer mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 133 linear feet of existing eight inch sewer main and easement and to accept approximately 302 linear feet of eight inch sewer main and easement for properties located at 800 and 802 Marquette Drive as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
