RESOLUTION NO. RS2016-261

A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, hereinafter called the “Licensee,” to enter into an Agreement For Utility Crossing with the Nashville and Eastern Railroad Corporation, hereinafter called “Licensor” to construct and maintain a water line until the year 2053 under the right-of-way and trackage of Licensor at milepost 7.74 in Donelson (Project No. 14WC0072).

WHEREAS, Licensee desires to construct, or cause to be constructed, to use and maintain until the year 2053, a 60 inch water main under the right-of-way and trackage of Licensor at milepost 7.74 in Donelson, pursuant to the terms of the Agreement For Utility Crossing, attached hereto as Exhibit A; and,

WHEREAS, Ordinance No. O98-1364 authorized The Metropolitan Government of Nashville and Davidson County to enter into agreements with Nashville and Eastern Railroad Corporation for water and sewer line construction by resolution; and,

WHEREAS, Licensee shall pay Licensor a one-time fee of Five Hundred and 00/100 Dollars ($500.00) upon execution of this contract; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement by and between The Metropolitan Government of Nashville and Davidson County and Nashville and Eastern Railroad Corporation, attached as Exhibit A, is hereby approved and the Director of the Metropolitan Department of Water and Sewerage Services is authorized to execute same.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
