RESOLUTION NO. RS2016-264
A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s property damage claim against Hardaway Construction Corp. and 3Form LLC in the amount of $75,000.00.
WHEREAS, the Metropolitan Government of Nashville and Davidson County (“Metro”) owns and through the Department of Parks and Recreation maintains certain property located at 592 South First Street, hereinafter referred to as Cumberland Park; and,
WHEREAS, Hardaway Construction Corp. and 3Form LLC built certain structures in Cumberland Park and have agreed to pay Metro $75,000 for repairs to such structures; and,
WHEREAS, after investigation, and pursuant to the proposed release attached to this resolution as Exhibit 1, the Department of Law believes the settlement is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the property damage claim of Metropolitan Government of Nashville and Davidson County against Hardaway Construction Corp. and 3Form LLC be settled in the amount of $75,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized execute the release (Exhibit 1) and to compromise and settle the Metropolitan Government’s property damage claim against Hardaway Construction and 3Form LLC for the sum of $75,000.00 with said amount to be allocated to the Department of Parks and Recreation to repair certain structures in Cumberland Park.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
