ORDINANCE NO. BL2016-256

An ordinance amending Title 16 of The Metropolitan Code, Buildings and Construction, Property Standards, by amending Section 16.04.172 and Section 16.24.190 to clarify the basis for the denial of permits to applicants guilty of and in current violation of Title 16, all of which is more particularly described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 16 of the Code of the Metropolitan Government of Nashville and Davidson County, Buildings and Construction, Property Standards, be and the same is hereby amended as follows:

By amending subsection 16.04.172.B by deleting it in its entirety and substituting the following:

B. In addition to any fine imposed for a violation of this title, permits granted under the provisions of this title may be revoked by the director. No new permits shall be issued to a person guilty of violating any provision of Title 16 until the work done or property conditions in violation of this title shall have been corrected to the satisfaction of the director.

Section 2. That Title 16 of the Code of the Metropolitan Government of Nashville and Davidson County, Buildings and Construction, Property Standards, be and the same is hereby amended as follows:

By amending Section 16.24.190 to add the following sentence at the end thereof:

16.24.190 - Prosecution of repeat violation.

Whenever the director determines that there has been a repeat violation of this chapter or has grounds to believe that a repeat violation has occurred, the director shall forego the issuance of a notice of violation and immediately institute the appropriate proceeding at law or in equity to restrain, enjoin, correct or abate such violation, or to require the removal or termination of the unlawful occupancy of the building, structure or premises in violation of this chapter. The director shall further refuse issuance of any permit under this title to persons in current violation of any provision thereof.
