ORDINANCE NO. BL2016-249

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent easements and temporary construction easements through negotiation, condemnation, or fee simple take, for the Cumberland City Low 60 inch Transmission Water Main Improvement Project for five properties located at various addresses (MWS Project No. 14-WC-0072, Proposal No. 2016M-015ES-001).

WHEREAS, the negotiation, condemnation, or fee simple take of temporary and permanent easements are needed to construct the Cumber City Low 60 inch Transmission Water Main for properties located at 2506 Elm Hill Pike, 0 Donelson Pike, 2330 Jackson Downs Boulevard and 3510 and 3516 Central Pike, Project No. 14-WC-0072; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-015ES-001 on April 7, 2016, for the negotiation, condemnation, or fee simple take of permanent and temporary construction easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate, condemn, or fee simple take temporary and permanent easements to construct the Cumber City Low 60 inch Transmission Water Main for properties located at 2506 Elm Hill Pike, 0 Donelson Pike, 2330 Jackson Downs Boulevard and 3510 and 3516 Central Pike as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations, condemnation, or fee simple take authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
