RESOLUTION NO. RS2016-268

A resolution recommending that the Metropolitan Transportation Licensing Commission amend its Rules and Procedures to restrict the issuance of licenses, permits and/or certificates for vehicles-for-hire to those vehicles that are in compliance with Tennessee vehicle registration requirements.

WHEREAS, Tennessee Code Annotated §§7-51-1001 through 1007 grant authority to metropolitan governments to license, control and regulate private passenger for-hire vehicles providing transportation services within their jurisdictions; and

WHEREAS, the Metropolitan Transportation Licensing Commission is vested with exclusive authority under Chapters 2.100, 6.72 through 6.81 and Chapter 12.54 of the Metropolitan Code of Laws to license and regulate passenger vehicles for hire in Nashville and Davidson County, including taxicabs, pedicabs, pedal carriages, wreckers, horse-drawn carriages, low speed vehicles and other vehicles, as well as operations for the “booting” of vehicles; and

WHEREAS, in pursuit of its duties, the Metropolitan Transportation Licensing Commission (MTLC) has promulgated Rules and Procedures regarding the licensure and operation of vehicles for hire, pursuant to the enabling authority of Titles 2 and 6 of the Metropolitan Code of Laws; and

WHEREAS, Nashville and Davidson County has witnessed an exponential growth in the number of vehicles for hire, serving primarily the tourism and visitor populations, including a variety of vehicles that may not necessarily comply with Tennessee state law regarding vehicle registration under Tenn. Code Ann. §55-3-101, et seq.; and

WHEREAS, for purposes of ensuring the safety of its citizens and to prevent disruption to the orderly flow of vehicular traffic, the MTLC should restrict the issuance of licenses, permits and/or certificates solely to those vehicles in compliance with Tennessee vehicle registration requirements.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as recommending that the Metropolitan Transportation Licensing Commission amend its Rules and Procedures to restrict the issuance of licenses, permits and/or certificates solely to those vehicles in compliance with Tennessee vehicle registration requirements.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to the members of the Metropolitan Transportation Licensing Commission and its Director, Mr. Billy Fields.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
