ORDINANCE NO. BL2016-243

An ordinance approving an agreement granting Lipscomb University access to the 800-MHZ system for public safety purposes.

WHEREAS, The Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and the Electric Power Board of The Metropolitan Government of Nashville and Davidson County ("NES") jointly own and operate an emergency radio dispatch and response system (“System”), utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission; and,

WHEREAS, the duties of Lipscomb University (“Lipscomb”), through its Office of Security and Safety, include providing and promoting public safety; and,

WHEREAS, Lipscomb has requested to be granted interoperability access to the System; and,

WHEREAS, access to the System would enhance Lipscomb’s ability to discharge its public safety duties and would also benefit the Metropolitan Government's efforts to provide public safety; and,

WHEREAS, the Metropolitan Government, NES and Lipscomb have agreed upon the terms of an agreement to allow Lipscomb access to the System.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement by and between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and Lipscomb University for access to the 800-MHZ System, attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute said Agreement.

Section 2. That any new amendments to the Agreement between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and Lipscomb University may be approved by resolution of the Metropolitan Council receiving at least twenty-one (21) affirmative votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
