ORDINANCE NO. BL2016-261

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and easement and to accept one new sewer manhole assembly and easement for property located at 420 Donelson Pike (MWS Project No. 16-SL-0043 and Proposal No. 2016M-023ES-001).

WHEREAS, the abandonment of approximately 149 linear feet of an existing eight inch sanitary sewer main and easement and the acceptance of one new sewer manhole assembly and easement for property located at 420 Donelson Pike are needed to construct project number 16-SL-0043, and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-023ES-001 on May 10, 2016 for the abandonment of said sewer main and easement and the acceptance of said new sewer manhole assembly and easements;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 149 linear feet of an existing eight inch sanitary sewer and easement and to accept one new sewer manhole assembly and easement for property located at 420 Donelson Pike, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
