The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.
The invocation was offered by Councilmember Parker Toler.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

confirmation, which motion was seconded and adopted by a unanimous vote of the
Council.
Reappointment of Father Edward Steiner for a term expiring December 31, 2008. At the request of the appointee, the nomination was deferred.
- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -
Mr. Dread withdrew his previously-offered amendment to Rule No. 1 of the Rules of Procedure of the Metropolitan Council and submitted the following proposed amendments to Rule No. 1 and Rule No. 27, which proposals were deferred:

A resolution approving an amendment to a grant from U.S. Department of Health and Human Services to The Metropolitan Government of Nashville and Davidson County, by and through the Board of Health, to improve and expand access to substance abuse, mental, dental, and other health services for uninsured residents of Davidson County. A resolution accepting a grant from the Opry Mills Mall Limited Partnership to The Metropolitan Government of Nashville and Davidson County by and through the Nashville Career Advancement Center for the Pearl Sims Learning and Development Center, and approving the grant agreement as amended. A resolution approving the settlement of the lawsuit brought by the Metropolitan Government against defendant American Manufacturers Mutual Insurance Company, said settlement being the payment of thirty-nine thousand dollars ($39,000) to the Metropolitan Government. A resolution authorizing the Doubletree Hotel (Sun Rockpoint Nashville Hotel Lessee, Inc, to install, construct and maintain stamped concrete that will overlay the sidewalk and install 4 new trees in the sidewalk at 315 4th Ave N (Proposal No. 2005M-037U-09). Mr. Jameson moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.
Without objection, the rules were suspended to accept a late resolution.
A resolution authorizing SESAC, Inc. to install, construct and maintain an aerial encroachment in right-of-way on utility poles for a distance of approximately 105 feet, in Alley No. 440, located behind 55 Music Square West (Proposal No.2005M-44U-10). The resolution was approved by the Public Works Committee. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 district to CS district property at 115 Benson Road, approximately 285 feet north of Old Lebanon Pike (0.53 acres), all of which is described herein (Proposal No. 2004Z-020U-14). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable to property abutting the east margin of Benson Road north of Old Lebanon Pike, classified R10 and proposed for CS (0.53 acres), the provisions of a Planned Unit Development District, to permit a paved 67 space parking area for the automobile dealership on an adjacent parcel of land (Proposal No. 2004P-007U-14). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
An ordinance authorizing the acquisition and/or exchange of property by negotiation or condemnation/fee simple take for the purpose of acquiring land and easements, for use in public projects of the Metropolitan Government, initially with relation to Project Number 03-WG-153A, Omohundro 48" Water Main-Alternate 36" Water Main and Master Meter Installations (Proposal No. 2005M-030U-11). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance amending Chapter 2.44 and Chapter 2.48 of the Metropolitan Code of Laws regarding the Meter Maid Patrol, all of which is more specifically described herein. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Traffic and Parking Committees by a voice vote of the Council.
An ordinance accepting a donation of $142.06 from Fred's Inc. for the use and benefit of the Metropolitan Police Department. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees by a voice vote of the Council.
- BILLS ON SECOND READING -
An ordinance amending Chapters 4.08 and 4.12 of the Metropolitan Code of Laws to prevent businesses performing auditing or consultant services for the Metropolitan Government from bidding on contracts involving the implementation of such recommendations for a period of five years. The bill was approved by the Budget and Finance Committee. Ms. Tucker offered Amendment Nos. 1 and 2 and moved for their adoption, which motion was seconded and adopted by a voice vote of the Council. Ms. Tucker moved to defer the bill indefinitely as amended, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Chapter 5.04 of the Metropolitan Code of Laws to provide certain reporting requirements for nonprofit organizations receiving grants from the Metropolitan Government. The bill was approved by the Budget and Finance Committee. Mr. Cole offered Amendment No. 2 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Cole moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Section 2.44.070 of the Metropolitan Code of Laws to enable meter maids to enforce the Code of Laws provision regarding the removal of dog excrement. The bill was disapproved by the Public Safety-Beer and Regulated Beverages Committee. Mr. Wallace moved to defer the bill on second reading because of related pending legislation, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD, CS to MUL district property at 1515 Lebanon Pike and 204 Spence Lane, located at the southeast corner of Spence Lane and Lebanon Pike (13.2 acres), all of which is described herein (Proposal No. 2005Z-030U-14). Mr. Loring offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. The bill was approved by the Planning Commission. An ordinance approving an agreement with the Oasis Center regarding participation in the Oasis Americorps Program. An ordinance establishing the Criminal Justice Planning Unit as a department of the Metropolitan Government. An ordinance amending Section 2.100.050 of the Metropolitan Code of Laws to require vehicles operated by Metropolitan Transportation Inspectors in furtherance of their duties to be clearly marked as transportation inspection vehicles. The bill was disapproved by the Public Safety-Beer and Regulated Beverages Committee . Mr. Isabel moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Section 16.04.200 and Section 16.24.330 of the Metropolitan Code of Laws to prohibit fences from extending past the front façade of single and two-family homes. The Codes, Fair and Farmers Market Committee recommended deferment. Mr. Wallace moved to defer the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance approving and authorizing the Mayor to execute a contract with the State of Tennessee Department of Transportation regarding the installation and maintenance of one or more traffic signals at SR-12 Ashland City Highway at SR-155 Briley Parkway, Exit 24 NB off ramp. The bill was approved by the Budget and Finance, Public Works and Traffic and Parking Committees. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance approving the disposition of certain parcels of surplus property by the Director of Public Property. (Proposal No. 2005M-031U-03). Mr. Isabel offered Amendment No. 2 and moved for its adoption, which motion was seconded and adopted by a roll call vote of the Council. An ordinance authorizing the acceptance of an easement described in the plans for Nashville Auto Diesel Stormwater Project No. 04-DL-0707 (Proposal No. 2004M-071U-05). Partners, Inc. for purposes of traffic infrastructure improvements at Newsome

No. 1 and moved for its adoption, which motion was seconded and adopted by a

An ordinance approving two agreements with Vanderbilt University for the participation and clinical training of medical students and residents in the Metropolitan Fire Department's first responder and ambulance and rescue programs. The bill was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees. Mr. Ryman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Ordinance No. BL2003-1533, as amended, to extend the boundaries of the Downtown PILOT Program, more particularly described herein. The Budget and Finance Committee recommended indefinite deferment. Mr. Isabel moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning right-of-way for Alley #66 from Alley #54 north to a dead end (Proposal No.2005M-054U-09). The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works, Traffic and Parking and Planning, Zoning and Historical Committees. Mr. Jameson moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance abandoning a sewer line and easement shown on Map 83-1, Parcel No. 459, Project 04-SL-48, Wal-Mart Neighborhood Market, located on Gallatin Pike, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2005M-055U-09). After discussion, Mr. Ryman called for the previous question, which motion was seconded and failed by a roll call vote of the Council. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RM6 district property at Old Hickory Blvd. (unnumbered) approximately 1,650 feet north of Logistics Way (60.41 acres), all of which is described herein (Proposal No. 2004Z-085G-13). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RS10 (79.30 acres), R8 (21.32 acres), RM9 (11.08 acres) district property at Burkitt Road (unnumbered) along the south side of Burkitt Road and the east side of Nolensville Pike, (111.7 acres total), all of which is described herein (Proposal No. 2004Z-152G-12). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development District located at Burkitt Road (unnumbered) on the south margin of Burkitt Road, approximately 1,000 feet east of Nolensville Pike, to permit 98 townhouse units, 52 duplex lots (104 units) and 243 single-family lots (111.70 acres), all of which is described herein (Proposal No. 2004P-035G-12). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee.
