ORDINANCE NO. BL2005-571

An ordinance abandoning a sewer line and easement shown on Map 83-1, Parcel No. 459, Project 04-SL-48, Wal-Mart Neighborhood Market, located on Gallatin Pike, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2005M-055U-09).

WHEREAS, an existing sewer line and accompanying easement, more particularly described in Project No. 04-SL-48, Wal-Mart Neighborhood Market, on record in the Department of Water and Sewer Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewer Services nor any other public utility; and

WHEREAS, the addition of a sewer manhole by the developer of the Wal-Mart Neighborhood Market will adequately serve the property currently encumbered by the sewer line and easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sewer line and accompanying sewer easement shown on Map 83-1, Parcel 459, Project No. 04-SL-48, Wal-Mart Neighborhood Market as indicated on the attached map, and the Director or Water and Sewer Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
