ORDINANCE NO. BL2004-414

An Ordinance amending Chapters 4.08 and 4.12 of the Metropolitan Code of Laws to prevent businesses performing auditing or consultant services for the Metropolitan Government from bidding on contracts involving the implementation of such recommendations for a period of five years.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Chapter 4.08 of the Metropolitan Code of Laws shall be and the same is hereby amended by amending Section 4.08.080 by adding the following new subsection F.:

“F. Notwithstanding any other provision of this chapter to the contrary, no business that has provided performance auditing or consultant services for the metropolitan government shall be eligible to bid on or be awarded any contract involving the implementation of the recommendations of such business for a period of five years from the date of making such recommendations.”

Section 2. Chapter 4.12 of the Metropolitan Code of Laws shall be and the same is hereby amended by adding the following new Section 4.12.230:

“4.12.030 Contracts relating to the implementation of performance audit or consultant recommendations.
Notwithstanding any other provision of this chapter to the contrary, no business that has provided performance auditing or consultant services for the metropolitan government shall be eligible to bid on or be awarded any contract involving the implementation of the recommendations of such business for a period of five years from the date of making such recommendations.”

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

I move to amend Ordinance No. BL2004-414 by amending Section 1 by deleting the Code section "4.12.030" and substituting in lieu thereof the Code section "4.12.230".

Mr. President:

I move to amend Ordinance No. BL2004-414 by amending Section 1 by adding the following sentence to the new subsection F:

"Specifically excluded from this prohibition are businesses that have provided legal services, fiscal agents services, financial advisor services, architectural services, engineering services, investment advisory services and medical consulting services."

Further, Section 2 is amended by adding the following sentence to the new Section 4.12.230:

"Specifically excluded from this prohibition are businesses that have provided legal services, fiscal agents services, financial advisor services, architectural services, engineering services, investment advisory services and medical consulting services."
