An ordinance amending Title 17 of the Metropolitan Code, zoning regulations, by amending Section 17.20.120 to clarify that fees in lieu of sidewalk construction are to be in addition to any funds appropriated by the Metropolitan Government as part of the comprehensive sidewalk program (Proposal No. 2005Z-003T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.20.120 by adding the following new sentence at the end of subsection D.1.:

“All fees in lieu of sidewalk construction shall be in addition to any other funds previously appropriated by the metropolitan council for sidewalk construction as part of the comprehensive sidewalk program.”

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
