An ordinance amending Title 17 of the Metropolitan Code of Laws, zoning regulations, by amending Section 17.32.040 to prohibit temporary signs affixed to storefront windows from covering more than twenty-five percent of the total storefront window area (Proposal No. 2005Z-020T).

WHEREAS, the Metropolitan Code of Laws currently exempts temporary merchandise displays and signs behind storefront windows from the sign regulations established in the Zoning Code; and

WHEREAS, limited visibility into stores due to the excessive use of temporary storefront signs and displays poses a threat to the safety of customers, the employees of the store, and emergency personnel; and

WHEREAS, in the interest of public safety and general welfare, it is fitting and proper that no more than twenty-five percent of a storefront window be covered by temporary merchandise displays and signs.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.32.040 by adding the following provision at the end of subsection M.:

", provided that such temporary signs do not cover more than twenty-five percent (25%) of the total surface area of the storefront window"

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
