RESOLUTION NO. RS2005-737


A resolution requesting BFI Waste Services, LLC, to comply with the Metropolitan Code of Laws provision prohibiting the collection of garbage within three hundred feet of a residence between the hours of eleven p.m. and seven a.m.

WHEREAS, BFI Waste Services, LLC, provides commercial and residential garbage collection services within the area of Nashville and Davidson County; and

WHEREAS, §10.20.300 of the Metropolitan Code of Laws makes it unlawful for any person to empty or remove any containers used for the accumulation or handling of garbage or rubbish between the hours of eleven p.m. and seven a.m. when said containers are located within three hundred feet of any structure used for residential purposes; and

WHEREAS, residents within the east Nashville area continuously complain that BFI is in violation of this ordinance, and have made repeated attempts to get BFI to address this problem; and

WHEREAS, these residents are being kept awake at all hours of the night as a result of this blatant disregard of the Metropolitan Code; and

WHEREAS, in an effort to show its willingness to be an upstanding corporate citizen in the Nashville community, it is fitting and proper that BFI take the steps necessary to abide by the Code provisions regarding hours of collection.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting BFI Waste Services, LLC to comply with the Metropolitan Code of Laws provision prohibiting the collection of garbage within three hundred feet of a residence between the hours of eleven p.m. and seven a.m.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to the Nashville management of BFI Waste Services, LLC, as well as the principal office in Scottsdale, Arizona.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
