RESOLUTION NO. RS2005-704

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to require owners of property that has previously been used as a methamphetamine laboratory to disclose this information to prospective renters and/or purchasers.

WHEREAS, illegal methamphetamine, a powerfully addictive stimulant, is manufactured using common household products and over-the-counter cold tablets containing pseudophederine; and

WHEREAS, the State of Tennessee has experienced an exponential growth in the number of illegal methamphetamine labs over the past five years; and

WHEREAS, the manufacturing of methamphetamine poses serious environmental and health risks to the community as a result of the discreet makeshift labs that produce hazardous emissions and toxic waste; and

WHEREAS, as a result of the dramatic increase in methamphetamine abuse and related manufacturing, Governor Phil Bredesen established the Governor's Task Force on Methamphetamine Abuse in April of 2004; and

WHEREAS, in its final report, the Governor's Task Force on Methamphetamine Abuse recommended an increase in comprehensive publicly available information regarding the dangers of methamphetamine; and

WHEREAS, the Task Force further recommended that the State maintain a statewide registry of contaminated properties in which methamphetamine laboratories are discovered; and

WHEREAS, purchasers or renters of property that has previously been used as a meth lab may be unaware of this fact, which poses serious hidden dangers to their health; and

WHEREAS, it is fitting and proper that owners of property that was previously used to manufacture methamphetamine be required to disclose this information to prospective renters and/or purchasers.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to require owners of property that has previously been used as a methamphetamine laboratory to disclose this information to prospective renters and/or purchasers.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution by United States mail, electronic mail, or interdepartmental mail to each member of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
