Metropolitan Council Meeting
Tuesday, December 4, 2001


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Ron Turner.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

ALARM APPEALS BOARD
Reappointment of Mr. Jamie Isabel to the Alarm Appeals Board for a term expiring November 4, 2003. The Rules-Confirmations-Public Elections Committee recommended deferment of the appointment. Ms. Williams moved to defer action on the confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mrs. Paula Rucker to the Alarm Appeals Board for a term expiring November 4, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

CHARITABLE SOLICITATIONS BOARD
Reappointment of Mr. Bert Hubbell to the Charitable Solicitations Board for a term expiring October 9, 2002. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Renata Soto to the Charitable Solicitations Board for a term expiring October 9, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

INDUSTRIAL DEVELOPMENT BOARD
The President called for an election to fill three six-year terms on the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County. Nominations previously made were: Timothy Ayers, Grace Fairbanks, Aubrey Gregory, Odie Jones, Sam Latham, and Hal Rosson. The nominations of Messrs. Ayers, Jones, and Latham were withdrawn at this time. Mr. Ferrell moved to elect by acclamation Mr. Ayers, Mrs. Fairbanks, and Mr. Gregory for terms expiring August 23, 2007, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2001-813

A resolution amending the 2001-2002 to 2006-2007 Capital Improvements Budget (Ordinance No. BL2001-705) to reclassify existing capital improvement projects and to add various capital improvement projects. The resolution was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees. A resolution appropriating five million three hundred thirty thousand nine hundred ninety nine dollars ($5,330,999) from the unappropriated fund balance of the General Fund of the General Services District and seven million five hundred thousand dollars ($7,500,000) from the unappropriated fund balance of the General Purpose School Fund to fund certain specified projects in the Mayor's Capital Spending Plan. The Budget and Finance and Education Committees recommended deferment of the resolution. RESOLUTION NO. RS2001-827

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed One Hundred Eighty Five Million Two Hundred Thousand Dollars ($185,200,000) to be financed by the ad valorem levy on property in the General Services District and in an aggregate principal amount of Twenty Six Million Five Hundred Thousand Dollars ($26,500,000) to be financed by the ad valorem levy on property in the Urban Services District. The Budget and Finance Committee recommended deferment of the resolution. Mr. Shulman moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2001-828

A resolution authorizing bond anticipation notes in an aggregate principal amount of not to exceed One Hundred Eighty Five Million Two Hundred Thousand Dollars ($185,200,000) to be financed by the ad valorem levy on property in the General Services District and in an aggregate principal amount of not to exceed Twenty Six Million Five Hundred Thousand Dollars ($26,500,000) to be financed by the ad valorem levy on property in the Urban Services District of the Metropolitan Government of Nashville and Davidson County; making provision for the issuance, sale and payment of said notes, and authorizing the expenditure of proceeds thereof. RESOLUTION NO. RS2001-829

A resolution authorizing the issuance of Convention Center Capital Outlay Notes in an amount not to exceed $1,057,000 of The Metropolitan Government of Nashville and Davidson County for the purpose of providing funds for Nashville Convention Center renovations and roofing, Project Nos. 01CV001 & 01CV002, and to declare the intent of The Metropolitan Government of Nashville and Davidson County to reimburse itself for certain expenditures with the proceeds of the General Services District Capital Outlay Notes. RESOLUTION NO. RS2001-846

A resolution requesting the Metropolitan Traffic and Parking Commission to restore Second Avenue North, between Broadway and Public Square, to a one-way street. Mr. Wallace offered a substitute resolution and moved that it be accepted for filing and no objection was made.

SUBSTITUTE RESOLUTION NO. RS2001-846

A substitute resolution requesting the Mayor and the Director of the Public Works Department to determine the cost to restore Second Avenue North, between Broadway and Public Square, to a one-way street. A resolution requesting the Metropolitan Government General Sessions Court judges to return fines imposed that exceeded the $50 maximum permitted under the Constitution of the State of Tennessee. RESOLUTION NO. RS2001-850

A resolution requesting the Metropolitan Government General Sessions Court judges to declare a period of amnesty, reduction, or suspension of payment of fines and court costs owed to assist in having operators licenses restored. A resolution appropriating $100,000 in Metropolitan Council reserve funds to support the Local Initiatives Support Corporation (LISC), a national non-profit intermediary working with local community development corporations on the financing of affordable housing and economic development projects. RESOLUTION NO. RS2001-867

A resolution authorizing the reclassification of certain property located at 4107 Old Hickory Boulevard, owned by The Metropolitan Government of Nashville and Davidson County, to create a park under the control of the Metropolitan Board of Parks and Recreation (Tax Map 101, Parcel 1) (2001M-128G-06). The resolution was approved by the Planning, Zoning, and Historical Committee; the Public Works and Parks, Library, Recreation and Auditorium Committees recommended deferment. RESOLUTION NO. RS2001-868

A resolution approving an Intergovernmental Agreement between the Hospital Authority and the Metropolitan Government transferring funds in an amount not to exceed Forty-Three Million Eight Hundred Sixty Thousand Dollars ($43,860,000.00) for the period November 1, 2001, through June 30, 2002, to facilitate receipt of funding from the State of Tennessee, and appropriating said funds, for the purposes of making a loan to the Metropolitan Hospital Authority. A resolution approving a grant from the State of Tennessee, Tennessee Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, for the provision of establishing programs to prepare dislocated workers for re-entry into the labor force to be administered through the Nashville Career Advancement Center (02-09-FY2-409-DSLWK). The resolution was approved by the Budget and Finance Committee.
