ORDINANCE NO. BL2001-917

An ordinance authorizing the Metropolitan Government to accept $55,000 from Vastland Realty Group, LLC.

Whereas, it was a condition of the Metropolitan Planning Commission's approval of Nashboro Village PUD, Tract 7, PUD No. 74-79-G-13, Subdivision No. 99S-355U, that the developer, Vastland Realty Group LLC (hereinafter "Vastland') construct a left turn lane at the intersection of Bell Road and Nashboro Boulevard (hereinafter "the intersection"); and

Whereas, planned improvements to the intersection in the near future would result in the removal and reconstruction of the left turn lane by the Department of Public Works, resulting in the improvement being done twice; and

Whereas, Vastland is willing to donate the sum of $55,000.00 to the Metropolitan Government, in lieu of being required to construct the left turn lane, provided said amount is applied to improvements at the intersection by the Metropolitan Government; and

Whereas, the Metropolitan Planning Commission staff has approved this change to the final site development plan conditions,

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1. The Metropolitan Government is authorized to accept the amount of $55,000.00 from Vastland Realty Group LLC for the purpose of constructing intersection improvements, including but not limited to a left turn lane, at the intersection of Bell Road and Nashboro Boulevard.

Section 2. Should any court of competent jurisdiction declare any section, clause, or provision of this ordinance to be unconstitutional, such decision shall affect only such section, clause or provision so declared unconstitutional, and shall not affect any other section, clause or provisions of this ordinance, it being the express intent of the Metropolitan County Council of The Metropolitan Government of Nashville and Davidson County that the remainder of this ordinance continue in full force and effect.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
