ORDINANCE NO. BL2001-886

An ordinance authorizing the Metropolitan Government to participate with Lenox Village I, LLC for the construction of Project No. 01-SL-100, 100A, 100B & 100C, Lenox Village.

WHEREAS, Lenox Village I, LLC has expressed a desire to provide improved public sewer service to southeast Davidson County, TN, known as Lenox Village; and

WHEREAS, it is deemed in the best interest of the public to construct the sewer system improvements, and the Metropolitan Government is agreeable to paying the lessor of 50% of the actual construction cost or $200,000; and

WHEREAS, this work is identified in METRO'S CAPITAL IMPROVEMENTS BUDGET as Project No. 01SG0002.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to execute the attached agreement, Exhibit 1, authorizing payment to Lenox Village I, LLC for the lessor of 50% of the installation cost or $200,000 to aid in the construction of the sewer improvements designated as Project No. 01-SL-100, 100A, 100B & 100C, to be paid from the Water and Sewer Replacement Fund.

SECTION 2: That the actual payment authorized in Section 1 shall not be made until Lenox Village I, LLC has executed a Deed of Conveyance to the Metropolitan Government for the improvements and proof of having released all mechanics and materialmans liens.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
