An ordinance authorizing the Metropolitan Government to participate with Lenox Village I, LLC for the construction of Project Nos. 97-WG-66B-2 and 01-WL-132, Lenox Village I Water Improvements.

WHEREAS, Lenox Village I, LLC has expressed a desire to provide public water system improvements to certain property in southeast Davidson County; and

WHEREAS, it is deemed in the best interest of the public to construct the water system improvements, and the Metropolitan Government is agreeable to paying the lessor of 50% of the actual construction costs or $100,000; and

WHEREAS, this work is identified in METRO'S CAPITAL IMPROVEMENTS BUDGET as Project No. 98WG0011.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to execute the attached agreement, Exhibit 1, authorizing payment to Lenox Village I, LLC in the amount of $90,000 for Project No. 97-WG-66B-2 and $10,000 for Project No. 01-WL-132 for a total amount of $100,000 or 50% of the actual construction cost of these projects, to be paid from the Water and Sewer Replacement Fund.

SECTION 2: That the payment authorized in Section 1 shall not be made until Lenox Village I, LLC has executed a Deed of Conveyance to the Metropolitan Government for the water improvements and proof of having released all mechanics and materialmans liens.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
