Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.
The invocation was offered by Councilmember Phil Ponder.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

- MAYOR'S MESSAGES -
Mr. Derryberry, sponsor of Bill No. BL2001-711 which was vetoed by the Mayor on July 3, 2001, offered no motion; therefore the veto was sustained.
- ELECTIONS AND CONFIRMATIONS -
Metropolitan
Action Commission
Appointment of Ms. Zulma Rivera to the Metropolitan Action Commission for a
term expiring February 2, 2004. Mr. Ferrell moved that the nomination be withdrawn,
which motion was seconded and adopted by a voice vote of the Council.
Electric
Power Board
Reappointment of Ms. Mary Jo Price to the Electric Power Board for a term expiring
July 1, 2006. The Rules-Confirmations-Public Elections Committee recommended
the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded
and adopted by a unanimous vote of the Council.
Employee
Benefit Board
Reappointment of Ms. Betsy Walkup to the Employee Benefit Board for a term expiring
June 30, 2004. The Rules-Confirmations-Public Elections Committee recommended
the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded
and adopted by a unanimous vote of the Council.
- RESOLUTIONS-
A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to enact necessary legislation to enable the Metropolitan Government to rebate up to $500.00 of property taxes to homeowners who install more energy efficient HVAC systems. The Budget and Finance Committee recommended deferment of the resolution. Mr. Hart moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.
A resolution approving an amendment to a lease agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission and Martha O'Bryan Center, Inc. to extend the lease term. The resolution was approved by the Planning Commission, Budget and Finance, Health, Hospitals and Social Services and Planning, Zoning and Historical Committees. A resolution requesting the Metropolitan Mayor to consider taking steps to renegotiate the Economic Development Grant Agreement with Dell Computer Corporation. A resolution requesting the Metropolitan Public Works Department to restore chipper service to a routed schedule. The Public Works Committee recommended deferment of the resolution. A resolution expressing the intent of the Metropolitan Council to provide funding to Nashville Public Television on behalf of the Metropolitan Board of Public Education in the operating budget for fiscal year 2002-2003. Mr. Majors moved that the first Council meeting in August be moved to Thursday, August 9, 2001, at 7 p.m., which motion was seconded and failed by a roll call vote of the Council.
- BILLS ON INTRODUCTION AND FIRST READING -
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5 District to CL District property at 2415 Brick Church Pike, approximately 400 feet north of Avondale Circle (0.30 acres), (Proposal No. 2001Z-053U-03), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
An ordinance authorizing Villages of Larchwood Homeowners Association to construct, install, and maintain a sign on the median of Blackwood Drive (Proposal No. 2001M-038G-14), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance amending the Metropolitan Code to authorize and establish a system, including administrative regulations, for voluntary contributions by employees of the Metropolitan Government through payroll deductions. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance abandoning the sewer lines and easements on Map 92-9, Parcel 31, (Proposal No. 2001M-029U-8) of Project No. 99-SL-213A, Preston Taylor Homes, Phase II, Sewer Lines and Easement Abandonment. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Public Works and Planning, Zoning and Historical Committees.
An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Book Publishing Company, including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before March 20, 2001. Upon motion duly seconded, the bill passed first reading and was referred to the Rules-Confirmations-Public Elections Committee by a voice vote of the Council.
An ordinance amending Section 11.12.070 of the Metropolitan Code by extending the area exempted from the provisions regulating excessive noise and hours of operation of entertainment establishments providing amplified sound. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer, Wine and Whiskey Committee by a voice vote of the Council.
An ordinance amending Article II and Article III of Chapter 2.04 of the Metropolitan Code relating to Standards for Ethical Conduct and Council Board of Ethical Conduct by revising the standards and the procedures for handling of complaints of misconduct. Upon motion duly seconded, the bill passed first reading and was referred to the Rules-Confirmations-Public Elections Committee by a voice vote of the Council.
- BILLS ON SECOND READING -
An ordinance amending Article
II of Chapter 2.04 of the Metropolitan Code relating to Standards for Ethical
Conduct by requiring annual disclosures by members of council of the receipt
of certain benefits and gifts. The Rules-Confirmations-Public Elections-Aviation
Committee recommended deferment of the bill. Mr. Ferrell moved to defer action
on the bill, which motion was seconded and adopted by a voice vote of the Council.
An ordinance approving the
disposition of certain property owned by The Metropolitan Government of Nashville
and Davidson County, Tennessee, in accordance with the terms and conditions
of the attached Memorandum of Understanding between The Metropolitan Government
of Nashville and Davidson County, Tennessee and the Metropolitan Development
and Housing Agency (232 3rd Avenue North, Tax Map 93-2-3, Parcel 155). The bill
was approved by the Planning Commission, Budget and Finance and Planning, Zoning
and Historical Committees. Mr. Gentry moved to pass the bill on second reading,
which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Section 12.40.040 of the Metropolitan Code by permitting parking within the Central Business Improvement District during certain evenings in some spaces where parking is now prohibited. The bill was disapproved by the Traffic and Parking Commission; the Traffic and Parking Committee recommended indefinite deferment. Mr. Wallace moved to defer action indefinitely on the bill, which motion was seconded and adopted by a voice vote of the Council.
An ordinance approving the
assignment and transfer of rights and obligations from Intermedia Partners Southeast
d/b/a AT&T Broadband to Comcast Cable Communications, Inc., under a lease
agreement with the Metropolitan Government. The bill was approved by the CATV
Special Committee and Budget and Finance Committee. Ms. McClendon moved to pass
the bill on second reading, which motion was seconded and adopted by a voice
vote of the Council.
BILL NO. BL2001-752
An ordinance authorizing
the acquisition of property by negotiation or condemnation (Proposal No. 2001M-039G-14)
for the purpose of acquiring utility easements and a fee simple take of 0.075
acres, more or less, for use in public projects of the Metropolitan Government
and specifically with relation to Project No. 01-SG-56, The Peninsula, Phase
I, Pump Station and Sewer Line. The bill was approved by the Planning Commission,
Budget and Finance, Public Works and Planning, Zoning and Historical Committees.
Mr. Ponder moved to pass the bill on second reading, which motion was seconded
and adopted by a voice vote of the Council.
BILL NO. BL2001-753
An ordinance authorizing
the acquisition of property by negotiation or condemnation (Proposal No. 2001M-037U-10)
for the purpose of acquiring utility easements for use in public projects of
the Metropolitan Government and specifically with relation to Project No. 99-SG-244,
Ashwood Avenue at 15th Avenue South Sanitary Sewer. The bill was approved by
the Planning Commission, Budget and Finance, Public Works and Planning, Zoning
and Historical Committees. Ms. Hausser moved to pass the bill on second reading,
which motion was seconded and adopted by a voice vote of the Council.
BILL NO. BL2001-754
An ordinance approving a
lease of premises by The Metropolitan Government of Nashville and Davidson County,
acting through the Metropolitan Board of Fair Commissioners, to Senior Citizens,
Inc. for a Senior Citizens Center. The bill was approved by the Planning Commission,
Budget and Finance, Codes, Fair and Farmers Market and Planning, Zoning and
Historical Committees. Mr. Greer moved to pass the bill on second reading, which
motion was seconded and adopted by a voice vote of the Council.

An ordinance approving the
transfer of certain property owned by The Metropolitan Government of Nashville
and Davidson County to the Metropolitan Development and Housing Agency (part
of property known as Boyd Park; Tax Map 92-5, part of Parcel 33). The bill was
approved by the Budget and Finance, Parks, Library, Recreation and Auditorium
and Planning, Zoning and Historical Committees. Mr. Whitmore moved to pass the
bill on second reading, which motion was seconded and adopted by a voice vote
of the Council.
BILL NO. BL2001-756
An ordinance accepting a
grant from the State of Tennessee, Department of Transportation to The Metropolitan
Government of Nashville and Davidson County, acting by and through the Metropolitan
Historical Commission, in an amount not to exceed $250,000 for the Hermitage
Replanting Project. The bill was approved by the Budget and Finance and Planning,
Zoning and Historical Committees. Mr. Brown moved to pass the bill on second

BILL NO. BL2001-757
An ordinance approving a contract between The Metropolitan Government of Nashville and Davidson County and The Hermitage for the implementation of an activity of the Surface Transportation Program, administered by the State of Tennessee, Department of Transportation for the replanting of trees at The Hermitage. The bill was approved by the Budget and Finance and Planning, Zoning and Historical Committees. Mr. Brown moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance approving a
grant agreement by and between the State of Tennessee, Department of Children's
Services, and The Metropolitan Government of Nashville and Davidson County,
by and through the Davidson County Juvenile Court, for the provision of child
and family intervention services through the Davidson County Juvenile Court's
Child and Family Intervention grant, in an amount not to exceed $641,674.00.

An ordinance approving the
acceptance of a grant from the United States Department of Justice, Bureau of
Justice Assistance in the amount of $11,178.98 to The Metropolitan Government
of Nashville and Davidson County for the purchase of bulletproof vests. The
bill was approved by the Budget and Finance and Public Safety-Beer, Wine and
Whiskey Committees. Ms. Hand moved to pass the bill on second reading, which

BILL NO. BL2001-760
An ordinance approving a
lease agreement between The Metropolitan Government of Nashville and Davidson
County, acting by and through the Metropolitan Police Department and Signature
Center, G.P. for the lease of office space for the Pass Program. The bill was

Planning, Zoning and Historical Committees. Ms. Hand moved to pass the bill

BILL NO. BL2001-761
An ordinance to amend the
Official Street and Alley Acceptance and Maintenance Map for The Metropolitan
Government of Nashville and Davidson County, by changing the name of North Hydes
Ferry Road to John Mallette Drive and Hydes Ferry Road, all of which is more
particularly described herein. The bill was approved by the Planning Commission,
E-911 Board, Public Works, Traffic and Parking and Planning, Zoning and Historical
Committees. Mr. Black moved to pass the bill on second reading, which motion
