ORDINANCE NO. BL2001-717
An ordinance authorizing the Metropolitan Government to enter into a contract for exchange of easements with BellSouth Telecommunications, Inc.
Whereas, the Metropolitan Government of Nashville and Davidson County and BellSouth Telecommunications, Inc., desire to enter into a contract for the exchange of certain easements and to provide for certain improvements and work related to said exchange; and
Whereas, the exchange will result in the dedication of a easement for a public pedestrian walkway on property owned by BellSouth, and the creation of an easement for parking purposes in favor of BellSouth on property owned by the Metropolitan Government; and
Whereas, it is in the best interests of the Metropolitan Government to enter into said contract,
Now, therefore, be it enacted
by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The attached contract with BellSouth Telecommunications, Inc. is
approved; and the Metropolitan Mayor is authorized to execute said contract.
Section 2. Should any court of competent jurisdiction declare any section, clause, or provision of this ordinance to be unconstitutional, such decision shall affect only such section, clause or provision so declared unconstitutional, and shall not affect any other section, clause or provisions of this ordinance, it being the express intent of the Metropolitan County Council of The Metropolitan Government of Nashville and Davidson County that the remainder of this ordinance continue in full force and effect.
Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
