Metropolitan Council Meeting
Tuesday, March 20, 2001


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Darrell Drumwright of Temple Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of March 6, 2001 were approved.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

The Rules-Confirmations-Public Elections Committee recommended deferment of proposed amendments to Rule Nos. 20 and 27 of the Rules of Procedure of the Metropolitan Council. Mr. Ferrell moved to defer the matter, which motion was seconded and adopted by a voice vote of the Council.

Mr. Ferrell reported that the Rules-Confirmations-Public Elections Committee had interviewed the following candidates to fill the vacancy on the Metropolitan Board of Public Education from School District 2 and found all to be qualified to serve if elected: Messrs. Vern Denney, Louis E. Morris Jr., and Albert Bender. An election to fill the vacancy will be conducted by the Metropolitan Council at its meeting of April 3, 2001.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Action Commission

Appointment of Ms. Dale Farran to the Metropolitan Action Commission for a term expiring March 6, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Corrections Advisory Board

Appointment of Ms. Janet Page to the Community Corrections Advisory Board for a term expiring March 30, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electrical Examiners and Appeals Board

Appointment of Mr. Jimmy Stansell, Jr. to the Electrical Examiners and Appeals Board for a term expiring February 15, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Parks and Recreation

Appointment of Justice Adolpho A. Birch, Jr. to the Board of Parks and Recreation for a term expiring April 30, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTIONS-

RESOLUTION NO. RS2001-541

A resolution requesting the Mayor to periodically inform the Metropolitan Council of lobbying efforts and status of legislation pending in the Tennessee State Legislature that affects the Metropolitan Government. The Rules-Confirmations-Public Elections-Aviation Committee recommended deferment of the resolution. Mr. Wallace moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2001-542

A resolution requesting the Tennessee Department of Transportation and the Metropolitan Department of Public Works to make safety improvements to Briley Parkway. The resolution was approved by the Public Safety-Beer, Wine and Whiskey Committee. RESOLUTION NO. RS2001-543

A resolution requesting Amtrak to restore passenger service to Nashville, Tennessee. The Transportation Committee recommended deferment of the resolution. Mr. Hall moved to defer the resolution upon the committee recommendation, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2001-544

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to adopt legislation that would enable the Metropolitan Government to impose a one and one-half cent gas tax on gasoline in the area of the Metropolitan Government. The resolution was disapproved by the Budget and Finance Committee. A resolution requesting the Metropolitan Board of Public Education to provide sufficient information on the back of school buses to allow the public to report violations or unsafe operations by drivers. A resolution appropriating $250,000 from the reserve account for affordable housing in the General Fund of the General Services District to the Affordable Housing account in the General Fund of the General Services District for the purpose of funding the Neighborhood Affordable Rental Development program for fiscal year 2000-2001. The Budget and Finance and Personnel-Public Information-Human Relations-Housing Committees recommended deferment of the resolution. Nineteenth Supplemental Electric System Revenue Bond Resolution. The resolution was approved by the Budget and Finance Committee. An ordinance voiding the agreement approved by Ordinance No. BL2000?137 and authorizing a new agreement to be entered into for Old Hickory Hills, LLC, to pay the Metropolitan Government, Department of Water and Sewerage Services, for operation and maintenance costs of the Old Hickory Hills pumping station and force main for their life, Project No. 99-SL-142. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2001-644

An ordinance authorizing the Library Board to keep a portion of the fees generated from rental charges for use of the facilities at the Main Library, for the purpose of maintaining and operating these facilities. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Parks, Library, Recreation and Auditorium Committees by a voice vote of the Council.

BILL NO. BL2001-645

An ordinance accepting a grant from the State of Tennessee, Department of Military, Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County in an amount not to exceed $558,822 for the debris removal project. Mr. Gentry offered a substitute bill and moved that it be accepted for filing and no objection was made.

SUBSTITUTE BILL NO. BL2001-645

A substitute ordinance accepting a grant from the State of Tennessee, Department of Military, Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County in an amount not to exceed $58,822 for the debris removal project. Upon motion duly seconded, the substitute bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL District to CS District property at 623 Old Hickory Boulevard, approximately 400 feet south of Interstate 40 (.95 acres), (Proposal No. 2001Z-020G-06), all of which is more particularly described herein. The bill was approved by the Planning Commission. BILL NO. BL2001-653

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the existing Commercial (General) Planned Unit Development District located abutting the west margin of Old Hickory Boulevard, 400 feet south of Interstate 40 (3.36 acres), classified CL and proposed for CS District, to add .95 acres and a 10,900 square foot autobody shop, (Proposal No. 88P-040G-06), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to RM4 District a portion of property at Franklin Limestone Road (unnumbered), approximately 140 feet southwest of Billingsgate Road (25.32 acres), (Proposal No. 2000Z?070U?13), all of which is more particularly described herein. The bill was disapproved by the Planning Commission and the Planning, Zoning and Historical Committee recommended deferment. Mr. Alexander moved to defer action on the bill, the bill being requested by Dale and Associates, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-599

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR District to CS District a portion of property at 710 Myatt Drive, approximately 900 feet east of Gallatin Pike (27 acres), (Proposal No. 2001Z-001G-04), all of which is more particularly described herein. The bill was approved by the Planning Commission and the Planning, Zoning and Historical Committee subject to payment of delinquent property taxes. Ms. Balthrop moved to defer action on the bill, the bill being requested by Warren Commercial Real Estate, LLC, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-624

An ordinance approving an increase in the amount of $620,000 to a grant to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, from the State of Tennessee, Department of Transportation, for the development of the downtown greenway. The bill was approved by the Budget and Finance and Parks, Library, Recreation and Auditorium Committees. Mr. Turner moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-625

An ordinance approving a grant in an amount not to exceed $199,924 from the State of Tennessee, Department of Finance and Administration to The Metropolitan Government of Nashville and Davidson County, acting through the 20th Judicial District Attorney General's Office for the Victims of Crime Act Grant Project titled Community Diversity Advocate Program. The bill was approved by the Budget and Finance Committee. Ms. McClendon moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-626

An ordinance approving a grant agreement for the grant of $557,241.06 from Workforce Essentials, Inc. to the Metropolitan Government, through the Nashville Career Advancement Center, for services under the Workforce Investment Act of 1998 and the American Competitiveness and Workforce Improvement Act of 1998. The bill was approved by the Budget and Finance Committee. Mr. Gentry moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-627

An ordinance amending Section 10.44.010 of the Metropolitan Code by redefining mass gatherings and amending Section 10.44.120 of the Metropolitan Code relating to security for crowd control. The Public Safety-Beer, Wine and Whiskey Committee recommended indefinite deferment of the bill. Mr. Derryberry moved to defer action indefinitely on the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-628

An ordinance accepting the donation of six thousand two hundred dollars ($6,200) to the Metropolitan Police Department Tactical Investigation Division from Gary Katz. The bill was approved by the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees. Ms. Hand moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-629

An ordinance approving the transfer of certain property owned by The Metropolitan Government of Nashville and Davidson County, Tennessee, to the Metropolitan Development and Housing Agency (4005 Indiana Avenue, Tax Map 91-12, Parcel 216). The bill was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees.
