A resolution approving an amendment to a cost-sharing agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, and the Department of the Army for planning work relating to the Richland Creek Greenway.

Whereas, in Bill No. BL2000-402, the Metropolitan Council approved an agreement (the "Agreement") between the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation and the Department of the Army under which the Department of the Army proposed to provide comprehensive plans (the "Project") for development, utilization and conservation of water and related land resources in connection with the Richland Creek Greenway; and

Whereas, pursuant to the terms of the document attached as Exhibit A to this Resolution, the parties seek to modify the Agreement to reflect an increase in the estimated total cost of the Project to one hundred ninety-six thousand dollars ($196,000); and

Whereas, the funds comprising the Metropolitan Government's revised sixty-three thousand one hundred twenty-nine dollar ($63,129) contribution to the first phase of the Project have been appropriated and are to be derived from Fund 40204 bu 42408150; and

Whereas, the citizens of Nashville and Davidson County will benefit by approval of the modification to the Agreement as proposed.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The proposed amendment to the Agreement (Exhibit A) is hereby approved.

Section 2. The Metropolitan Mayor is authorized to execute the amendment.

Section 3. Any further amendment to the Agreement may be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

Section 4. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
