Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by singer and songwriter, Danny Flowers.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of July 19, 2016 were approved.

- ELECTIONS AND CONFIRMATIONS -

Auditorium Commission
Appointment of Ms. Paulette Hanson for a term expiring June 30, 2019. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Health
Reappointment of Dr. Tom Campbell for a term expiring July 9, 2021. Mr. Shulman moved for confirmation, which motion was seconded and adopted by voice vote of the Council.

Historic Zoning Commission
Appointment of Mr. Elizabeth Mayhall for a term expiring June 1, 2021. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education Community and Arts Television (NECAT)
Appointment of Mr. Joey Leslie for a term expiring February 5, 2018. Mr. Leslie will fill the unexpired term of Mr. Mike Kopp. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- BILLS ON PUBLIC HEARING -

SUBSTITUTE BILL NO. BL2016-133

An ordinance to amend various sections of Title 17 of the Metropolitan Zoning Code to incentivize Inclusionary Housing with any residential development that seeks additional development entitlements beyond that permitted by the current base zoning district
(Proposal No. 2016Z-001TX-001). The bill was approved by the Planning Commission with a second substitute. Ms. Allen requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Ms. Allen moved to pass the bill on second reading and defer the bill to the first meeting in September, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2016-265

An ordinance amending Section 17.40.120 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the determination of inactivity of a planned unit development, all of which is more particularly described herein. (Proposal No. 2016Z-011TX-001). Ms. Mina Johnson moved to defer the bill to the September public hearing, which motion was seconded and approved by a voice vote of the Council with Ms. Weiner abstaining.

BILL NO. BL2016-293

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL, RS5, and SP-R to R6-A zoning for various properties located along Berry Street, Cleveland Street, Grace Street, Hancock Street, Lischey Avenue, Meridian Street, North 2nd Street, Stockell Street, and Treutland Avenue (53.83 acres), all of which is described herein (Proposal No. 2016Z-036PR-001). The bill was disapproved by the Planning Commission. Mr. Scott Davis moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2016-304

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for property located at 1016 33rd Avenue North, approximately 70 feet south of Alameda Street (0.29 acres), to permit four residential units within the existing structure, all of which is described herein (Proposal No. 2016SP-036-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Kindall requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Kindall moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to MUL-A zoning for property located at 615 26th Avenue North, at the southeast corner of Clifton Avenue and 26th Avenue North (0.75 acres), all of which is described herein (Proposal No. 2016Z-032PR-001). The bill was approved by the Planning Commission. Mr. Kindall requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Kindall moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to MUL-A zoning for property located at 2701, 2703, and 2705 Clifton Avenue, at the southwest corner of the intersection of Clifton Avenue and 27th Avenue North (0.67 acres), all of which is described herein (Proposal No. 2016Z-046PR-001). The bill was approved by the Planning Commission. Mr. Kindall requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Kindall moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-309

An ordinance amending Sections 6.28.030, 17.16.250, and Chapter 17.32 of the Metropolitan Code with regard to sign regulation (2016Z-013TX-001). The bill was approved by the Planning Commission with an amendment. Ms. Allen requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in favor of the bill. The President declared the public hearing closed. Ms. Allen offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Ms. Allen moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-319

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CN, RS5 and SP to SP zoning for properties located at 1224, 1225, 1227, 1229, 1231 and 1300 Lischey Avenue, approximately 210 feet northeast of Richardson Avenue (1.97 acres), to permit all uses permitted by the MUL-A district except for alternative financial services uses, all of which is described herein (Proposal No. 2016SP-047-001). The bill was disapproved by the Planning Commission as submitted; approved with amendments and conditions, disapproved without. Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Ridgeview Urban Design Overlay (UDO) District for property located at Bell Road (unnumbered), approximately 500 feet east of Bell Road, zoned RM9 and MUL (approximately 63 acres), to permit a mixed use development with applicable design standards, all of which is described herein (Proposal No. 2003UD-003-003). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Dowell requested a hearing from the public on this bill which had been previously advertised. A resolution recognizing Mr. Chris Henson for his service to Nashville and the Metropolitan School System. The resolution was approved by the Education Committee.

RESOLUTION NO. RS2016-321

A resolution approving an interlocal agreement between the Emergency Communications District for Nashville and Davidson County and The Metropolitan Government of Nashville and Davidson County for provision of services and reimbursement of costs pertaining to Enhanced-911 services. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-322

A resolution approving an intergovernmental agreement by and between the United States Government, by and through Medicare, and the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Fire Department, to allow the Fire Department to bill Medicare. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-323

A resolution approving a contract between the State of Tennessee, Department of Mental Health and Substance Abuse Services, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Fire Department, authorizing the State to pay the Metropolitan Government for Emergency Transportation Services. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-324

A resolution approving an application for a Litter Grant from the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Sheriff’s Department, to reduce litter along county, state, and interstate highways and roads within the Metropolitan Nashville – Davidson County area. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-325

A resolution approving an intergovernmental agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, and Tennessee State University for extra-duty police services.

RESOLUTION NO. RS2016-326

A resolution approving an agreement between the United States Department of Justice, Drug Enforcement Administration (“DEA”), and the Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police Department, to provide police assistance to the Middle Tennessee Drug Enforcement Task Force. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-327

A resolution approving an application for the Edward Byrne Memorial Justice Assistance Grant (JAG) from the United States Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for equipment and supplies for direct support for basic police, in-service, and specialized training. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-328

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, to support the provision of mental health services and criminal justice system advocacy to victims of violent crime. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-329

A resolution accepting a grant from the State of Tennessee, Tennessee State Library and Archives, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to target library materials to persons having difficulty using a library and to provide special services to children and young people. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-330

A resolution approving an application for the Library Services and Technology Act (LSTA) Grant from the State of Tennessee, Tennessee State Library and Archives, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to provide a well-trained library staff to assist customers in accessing technology. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-331

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide food safety services and ensure environmental assessments are conducted for all foodborne disease outbreaks. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-332

A resolution approving a clinical/practicum affiliation agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and The Tennessee Board of Regents (TBR) to provide clinical/ practicum experiences for students enrolled in the TN eCampus Masters of Science in Nursing (MSN) Program. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-334

A resolution approving an interlocal agreement by and between The City of Brentwood and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for cooperation of regional traffic signal management in the area jointly bordered in southern Davidson County and northern Williamson County. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-336

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Cortney Akridge against Officer Ryan Martin Finnegan, in the amount of $52,947.75 and that said amount be paid out of the Judgments and Losses Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-337

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

A resolution requesting the Public Works Department to provide the Metropolitan Council with an updated list of sidewalks and proposed sidewalks around Metro Nashville Public Schools. Mr. Shulman offered a substitute resolution and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2016-335

A resolution accepting a grant from the Metropolitan Development and Housing Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical Commission, to perform Section 106 environmental review necessary for development proposals using federal funds to determine potentially adverse effects to historic properties. The resolution was approved by the Budget and Finance and Planning, Zoning, and Historical Committees. Mr. Pridemore moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-342

An ordinance amending Title 2 of the Metropolitan Code to create an affordable and workforce housing grant program. Upon motion duly seconded, the bill passed first reading and was referred to the Ad Hoc Affordable Housing, Budget and Finance, Personnel, Public Information, Human Relations, and Housing and Planning, Zoning, and Historical Committees by a voice vote of the Council.

BILL NO. BL2016-343

An ordinance to amend Title 13 of the Metropolitan Code of Laws by adding a new chapter to facilitate efficient access to and enhance the public safety and convenience for accessing the public rights-of-way to manage communications facilities. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-344

An ordinance authorizing the Board of Parks and Recreation to issue a permit allowing the United States Government, acting by and through the Department of the Navy, to land and take off aircraft on The Green, a park owned by the Metropolitan Government of Nashville and Davidson County and maintained and operated by the Department of Parks and Recreation, in conjunction with Marine Week. Upon motion duly seconded, the bill passed first reading and was referred to the Parks, Library, and Recreation Committee by a voice vote of the Council with Mr. Sledge abstaining.

BILL NO. BL2016-345

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing water main and one fire hydrant and to accept new water mains and four fire hydrants and any associated easements for property located at 1100 Charlotte Avenue (MWS Project 14-WL-135 and Proposal No. 2016M-028ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-346

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and easement and to accept new sewer main and easement for property located at 1104 Safety Harbor Cove (MWS Project 16-SL-101 and Proposal No. 2016M-029ES-001). The bill was approved by Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.
