ORDINANCE NO. BL2016-347

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and manholes and to accept new sewer mains, manholes, new water mains, fire hydrant assemblies and easements for properties located at 512, 514, 518, 520 Southgate Avenue and 1608 Pillow Street (MWS Projects 16-SL-0047 and 16-L-0061 and Proposal No. 2016M-035ES-001).

WHEREAS, the abandonment of approximately 185 linear feet of an existing eight inch sanitary sewer main and three sewer manholes assemblies and the acceptance of approximately 532 linear feet of new eight inch PVC sanitary sewer main, 55 linear feet of new eight inch DIP sanitary sewer main, eight new manholes assemblies, approximately 316 linear feet of new eight inch public water main, 308 linear feet of new six inch public water main, two fire hydrant assemblies and any associated easements for properties located at 512, 514, 518, 520 Southgate Avenue and 1608 Pillow Street, are needed to construct MWS Project 16-SL-0047 and 16-WL-0061; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-035ES-001 on July 6, 2016, for the abandonment and acceptance of said sewer mains, manholes, water mains, fire hydrants and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 185 linear feet of an existing eight inch sanitary sewer main and three sewer manholes assemblies and to accept approximately 532 linear feet of new eight inch PVC sanitary sewer main, 55 linear feet of new eight inch DIP sanitary sewer main, eight new manholes assemblies, approximately 316 linear feet of new eight inch public water main, 308 linear feet of new six inch public water main, two fire hydrant assemblies and any associated easements for properties located at 512, 514, 518, 520 Southgate Avenue and 1608 Pillow Street, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
