ORDINANCE NO. BL2016-346

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and easement and to accept new sewer main and easement for property located at 1104 Safety Harbor Cove (MWS Project 16-SL-101 and Proposal No. 2016M-029ES-001).

WHEREAS, the abandonment of approximately 101 linear feet of eight inch sanitary sewer main and the acceptance of approximately 110 linear feet of eight inch DIP public sewer main and three manhole assemblies and any associated easements for property located at 1104 Safety Harbor Cove, is needed to construct MWS 16-SL-101; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-029ES-001 on June 28, 2016, for the abandonment and acceptance of said sewer main and easement;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 101 linear feet of eight inch sanitary sewer main and to accept approximately 110 linear feet of eight inch DIP public sewer main and three manhole assemblies and any associated easement for property located 1104 Safety Harbor Cove, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
