ORDINANCE NO. BL2016-344

An ordinance authorizing the Board of Parks and Recreation to issue a permit allowing the United States Government, acting by and through the Department of the Navy, to land and take off aircraft on The Green, a park owned by The Metropolitan Government of Nashville and Davidson County and maintained and operated by the Department of Parks and Recreation, in conjunction with Marine Week.

WHEREAS, Section 13.24.400 of The Metropolitan Government of Nashville and Davidson County Code of Laws prohibits landing any type of aviation apparatus upon any park owned by The Metropolitan Government of Nashville and Davidson County; and,

WHEREAS, Chapter 11.1002 of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the Board of Parks and Recreation to supervise, control, and operate the park and recreation system of the Metropolitan Government; and,

WHEREAS, Section 13.24.070 of The Metropolitan Government of Nashville and Davidson County Code of Laws authorizes the Board of Parks and Recreation to issue permits for certain activities and uses of park property; and,

WHEREAS, the United States Government, acting by and through the Department of the Navy, requested to land and take off helicopters and a plane on the Green, which is a park owned by The Metropolitan Government of Nashville and Davidson County and operated and maintained by the Department of Parks and Recreation, in conjunction with Marine Week, an event occurring downtown.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Board of Parks and Recreation is authorized to issue a permit to the United States Government for landing and taking off aircraft on The Green, a park owned by The Metropolitan Government of Nashville and Davidson County and maintained and operated by the Department of Parks and Recreation, in conjunction with Marine Week.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
