Metropolitan Council Meeting
Thursday, May 4, 2006


The Metropolitan Council met in regular session on this date at 6:30 p.m. in Metro City Hall.

The invocation was offered by Councilman Buck Dozier.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Hart, Forkum, Ryman, Brown, Burch, White, Loring, Greer, Hausser, Wallace, Whitmore, Crafton, Shulman, Adkins, Foster, Alexander, Wilhoite, Toler, Coleman, Williams, Tygard and President Gentry (31); Absent: Neighbors, Cole, Gotto, McClendon, Walls, Summers (6).

The Minutes of the regular meeting of April 18, 2006, were approved.

The President announced a vacancy in the School District No. 5 seat on the Metropolitan Board of Public Education. Nominations must be filed with the Metropolitan Clerk not later than 4:00 p.m. on Thursday, May 11, 2006, and an election will be conducted at the next regular meeting of the Council.


- ELECTIONS AND CONFIRMATIONS -

Action Commission
Appointment of Ms. Karen Doty for a term expiring February 2, 2008. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Candace Reynolds for a term expiring February 2, 2008. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Equalization
Reappointment of Mr. Spruell Driver, Jr. for a term expiring April 1, 2008, as an Urban Services District representative. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. John Flanagan for a term expiring April 1, 2008, as a General Services District representative. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Farmers Market Board
Reappointment of Mr. Bill Coke for a term expiring May 5, 2011. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Anna Parsons-Elsberry for a term expiring May 5, 2011. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fire and Building Code Appeals Board
Appointment of Mr. Randall Barnes for a term expiring February 1, 2010, as the Fire Prevention Specialist. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Appointment of Rev. George Brooks for a term expiring April 18, 2009. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. German Castro for a term expiring April 18, 2009. Without objection the nomination was deferred to May 16, 2006.

Reappointment of Ms. Nonye Ejiofor for a term expiring April 18, 2009. Without objection the nomination was deferred to June 6, 2006.

Reappointment of Ms. Jen-Jen Lin for a term expiring April 18, 2009. Without objection the nomination was deferred to May 16, 2006.

Reappointment of Dr. Connie Smith for a term expiring April 18, 2009. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Father Charles Strobel for a term expiring April 18, 2009. Without objection the nomination was deferred to May 16, 2006.

Plumbing Examiners and Appeals Board
Reappointment of Mr. Michael Trigg for a term expiring March 10, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Property Standards and Appeals Board
Reappointment of Ms. Jan Bushing for a term expiring April 7, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Deborah Cole for a term expiring April 7, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Social Services Commission
Reappointment of Ms. Gwendolyn Harris for a term expiring April 3, 2011. Without objection the nomination was deferred to May 16, 2006.

Sports Authority
Appointment of Mr. Ralph Perrey for a term expiring February 20, 2012, as the School District 9 representative. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Transit Authority
Reappointment of Ms. Marian Ott for a term expiring May 1, 2011. Without objection the nomination was deferred to May 16, 2006.

Transportation Licensing Commission
Reappointment of Mr. Ray Dayal for a term expiring April 30, 2008. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Gladys Lozada for a term expiring April 30, 2008. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

BILL NO. BL2006-967

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to IR district property located at 1705 River Hills Drive (0.18), all of which is described herein (Proposal No. 2005Z-176U-14). The bill was approved by the Planning Commission. Mr. Loring requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Loring moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-999

An ordinance amending Section 17.40.300 of Title 17 of the Metropolitan Code, Zoning Regulations, to require the Board of Zoning Appeals to provide the applicant for a special exception with a copy of the Planning Commission Report regarding the application prior to the public hearing, all of which is more specifically described herein (Proposal No. 2006Z-049T). The bill was approved by the Planning Commission. Ms. Williams requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Williams moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1024

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by requesting to apply a Neighborhood Landmark Overlay District to the Oglesby Community Club located at 5724 Edmondson Pike, approximately 565 feet south of Old Hickory Boulevard (1.47 acres), all of which is described herein (Proposal No. 2006Z-028G-12). The bill was approved by the Planning Commission. Mr. Toler requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Toler moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1025

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 and MUN to MUL district properties located at 101, 103, and 107 Charles E. Davis Boulevard, at the northeast corner of Charles E. Davis Boulevard and Cannon Street (.48 acres), all of which is described herein (Proposal No. 2006Z-031U-11). The bill was approved by the Planning Commission. Mr. Greer requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. BILL NO. BL2006-1026

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a portion of a Planned Unit Development located at 5433 Mt. View Parkway, all of which is described herein (Proposal No. 37-79-U-13). The bill was approved by the Planning Commission.

BILL NO. BL2006-1027

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to SP zoning property, located at 5433 Mt. View Parkway (2.07 acres), to permit a 3,812 square foot bank (2.07 acres), all of which is described herein (Proposal No. 2006SP-041U-13). The bill was approved by the Planning Commission.

Mr. Coleman requested a hearing from the public on the bills which had been previously advertised. BILL NO. BL2006-1028

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development district located at 212 25th Avenue North, to permit an existing 125,000 square foot office/restaurant building an exemption, from the minimum distance requirement included in the beer provisions of the Metro Code (1.22 acres), all of which is described herein (Proposal No. 2006P-003U-10). The bill was approved by the Planning Commission. Mr. Whitmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Whitmore moved to pass the bill on second reading and defer the bill to the first meeting in June, the bill being requested by Barge Cauthen & Associates, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1029

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to CL district property located at 4416 Bass Avenue, approximately 300 feet west of Nolensville Pike (0.12 acres), all of which is described herein (Proposal No. 2006Z-024U-12). The bill was approved by the Planning Commission. Mr. Foster moved to defer the bill to the July public hearing due to insufficient notice, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1030

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Planned Unit Development district located at 343, 347 Harding Place, and 309 South Perimeter Park Drive, to permit 207,689 square feet of hotel and restaurant uses, all of which is more particularly described herein (Proposal No. 206-69-G-13). The bill was approved by the Planning Commission. Mr. Alexander requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2006-1031

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 to RM4 (36.25 acres) district property located at Hicks Road (unnumbered), approximately 300 feet north of Stirrup Drive, all of which is described herein (Proposal No. 2006Z-023G-06). The bill was approved by the Planning Commission. Mr. Crafton moved to defer the bill to the July public hearing while he awaits contact from the applicants, the bill being requested by Chris Fort and Fort Family, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying an Historic Landmark Overlay District to property located at 1220 Gallatin Pike, approximately 155 feet south of Douglas Avenue, (.28 acres) all of which is described herein (Proposal No. 2006Z-032U-05). The bill was approved by the Planning Commission. Ms. Murray requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development district located at 91 Tusculum Road, to allow 40 townhomes (4.45 acres), all of which is described herein (Proposal No. 2006P-004U-12). The bill was approved by the Planning Commission. Mr. Coleman to defer the bill to the July public hearing so it can track with a companion base zone change bill, the bill being requested by Batson Engineering, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1036

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to MUG zoning properties at 2100 and 2104 Clifton Avenue, at the northwest corner of Clifton Avenue and 21st Avenue North (.63 acres), all of which is described herein (Proposal No. 2006Z-051U-08). BILL NO. BL2006-1039

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5 and OL to SP district properties located at 4601 and 4603 Gallatin Pike and Broadmoor Drive (unnumbered), northwest corner of Gallatin Pike and Broadmoor Drive (.84 acres), to permit a 960 square feet retail uses, 1,109 square feet of retail storage, and 531 square feet for a coffee shop/refreshment counter (0.88 acres), all of which is described herein (Proposal No. 2006SP-052U-05). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning, properties located at 1818 and 1900 Eastland Avenue and Eastland Avenue (unnumbered), between 18th and 20th Streets, to permit the development 99 residential units, 18,600 square feet of retail uses, 18,500 square feet of restaurant uses, 20,500 square feet of office uses, 6,800 square feet of personal care service uses, 3,000 square feet of custom assembly uses, and 3 single-family lots (7.26 acres), all of which is described herein (Proposal No. 2005SP-170U-05). BILL NO. BL2006-1044

An ordinance amending Chapters 17.04 and 17.08 of Title 17 of the Metropolitan Code, Zoning Regulations, to add the use "After hours establishment" as a use permitted in the CL, CS, CF, CC, IWD, IR and IG districts, all of which is more specifically described herein (Proposal No. 2006Z-064T). Mr. Dread moved to defer the bill to the July public hearing, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1045

An ordinance amending Section 17.28.030 of Title 17 of the Metropolitan Code, Zoning Regulations, relative to the minimum building envelopes at the building setback, all of which is more specifically described herein (Proposal No. 2006Z-063T). An ordinance to amend various sections of Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County relative to the bulk standards and scenic landscape easements applicable to the AG, AR2a, R80, RS80, R40, and RS40 zoning districts in order to provide for significant protection of unique natural, cultural, and historical resources and adding applicable definitions (Proposal No 2006Z-014T). BILL NO. BL2006-1049

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to SP zoning properties located at 1211, 1215, 1217, 1219, and 1229 4th Avenue North, 4th Avenue North (unnumbered) and 407 Monroe Street, (1.67 acres), to permit the development of 35 townhomes 1,661 square feet of retail and restaurant space, and a 920 square foot club house (1.67 acres), all of which is described herein (Proposal No. 2006SP-016U-08). Mr. Wallace moved to withdraw the bill, the bill being requested by Dale and Associates, which motion was seconded and adopted by a voice vote of the Council.
