Metropolitan Council Meeting
Tuesday, March 1, 2005


The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.

The invocation was offered by Councilmember Buck Dozier.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the meeting of February 15, 2005, were approved.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Isabel, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Gotto, White, Loring, McClendon, Greer, Hausser, Wallace, Walls, Whitmore, Crafton, Whitson, Summers, Shulman, Adkins, Foster, Alexander, Wilhoite, Toler, Coleman, Bradley, Williams, Tygard and President Gentry (35); Absent: Gilmore, Brown, Hart, Burch, Kerstetter (5).

- ELECTIONS AND CONFIRMATIONS -

Action Commission
Reappointment of Mr. Robert McNeilly, Jr. for a term expiring February 2, 2008. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Emergency Communications District Board
Reappointment of Mr. Michael Stewart for a term expiring February 14, 2009, as the School District 3 representative. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Joe Sweat for a term expiring February 14, 2009, as the School District 9 representative. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Farmers Market Board
Appointment of Ms. Audrey Buchanan for a term expiring December 5, 2006. At the request of the appointee, the nomination was withdrawn.

Appointment of Ms. Kay West for a term expiring December 19, 2009. At the request of the appointee, the nomination was deferred.

Solid Waste Region Board
Appointment of Ms. Alma Sanford for a term expiring December 15, 2010. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Stormwater Management Committee
Appointment of Mr. Charles Gamble for a term expiring October 31, 2008, as a Community-at-Large representative. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Work Release Commission
Reappointment of Mr. Jim Boyd for a term expiring December 31, 2008. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Mona Frederick for a term expiring December 31, 2008. At the request of the appointee, the nomination was deferred.

Reappointment of Rev. Frank Gordon for a term expiring December 31, 2008. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Father Edward Steiner for a term expiring December 31, 2008. At the request of the appointee, the nomination was deferred.

Without objection, the rules were suspended to accept a late resolution.

A resolution recognizing Seikichi Sato for a lifetime of tireless dedication and devoted service to Miyagi Prefecture and his beloved home town, Kakuda.

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.40.060 regarding applications to amend the Official Zoning Map (Proposal No. 2005Z-001T). BILL NO. BL2004-490

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.36.260 regarding locational standards for adult entertainment establishments, all of which is more specifically described herein (Proposal No. 2004Z-025T). The bill was approved by the Planning Commission. Mr. Foster requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2004-491

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.20.120 to clarify that fees in lieu of sidewalk construction are to be in addition to any funds appropriated by the Metropolitan Government as part of the comprehensive sidewalk program (Proposal No. 2005Z-003T). The bill was approved by the Planning Commission. Ms. McClendon requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2005-523

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development District located on the west margin Old Hickory Boulevard 1,600 feet north of Logistics Way, to permit 342 multi-family units and 20 single-family lot (60.41 acres), all of which is described herein (Proposal No. 2004P-028G-13). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RM15 district property at 2834 Old Franklin Road, Route 2 Old Franklin Road approximately 360 feet south of Mt. View Road (10 acres), all of which is described herein (Proposal No. 2004Z-069U-13). The bill was approved by the Planning Commission.

BILL NO. BL2005-528

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development District located abutting the east margin of Old Franklin Road (unnumbered), south of Mt. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to CS district property at 2368 Gallatin Pike North east of Liberty Lane (1.14 acres), all of which is described herein (Proposal No. 2005Z-029U-04). Mr. Ryman moved to defer the bill to the May public hearing inasmuch as the Planning Commission had not yet made a recommendation, the bill being requested by Andrew R. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to RM40 district property located at 112 Harding Place, approximately 360 feet east of Harding Pike, (0.83 acres), all of which is described herein (Proposal No. 2005Z-012U-07). The bill was approved by the Planning Commission.

BILL NO. BL2005-542

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD, CS to MUG district property at 1515 Lebanon Pike and 204 Spence Lane, south of Lebanon Pike and east of Spence Lane (14.86 acres), all of which is described herein (Proposal No. 2005Z-030U-14). Mr. Loring requested a suspension of the rules for a public hearing on this bill without a Planning Commission recommendation, and no objection was made. BILL NO. BL2005-552

An ordinance amending Title 17 of the Metropolitan Code of Laws, zoning regulations, by amending Section 17.32.040 to prohibit temporary signs affixed to storefront windows from covering more than twenty-five percent of the total storefront window area (Proposal No. 2005Z-020T). The bill was approved by the Planning Commission. Mr. Bradley requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Bradley moved to pass the bill on second reading, which motion was seconded. Mr. Isabel moved to defer the bill, which motion was seconded. Mr. Ryman moved to table the motion to defer, which motion was seconded and adopted by a voice vote of the Council. The matter recurred on the motion to pass the bill on second reading, which motion was adopted by a voice vote of the Council.

BILL NO. BL2005-553

An ordinance amending Title 17 of the Metropolitan Code, zoning regulations, by amending Section 17.40.120 to require that district councilmembers be notified by the planning commission upon the filing of a master development plan application (Proposal No. 2005Z-031T). Mr. Gotto moved to defer the bill to the May public hearing for a Planning Commission recommendation, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-554

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling an undeveloped portion of a Residential Planned Unit Development District approved for 74 multi-family units, located at Old Hickory Boulevard (unnumbered), north of Central Pike (10.65 acres), all of which is described herein (Proposal No. 154-73-G-14). The bill was approved by the Planning Commission. Mr. Gotto requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and citizens were heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Gotto moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-555

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying the Institutional Overlay district to various properties between Belmont Boulevard, 15th Avenue South and 12th Avenue South and between Wedgewood Avenue and Ashwood Avenue, including properties along Acklen Avenue, Bernard Avenue, Compton Avenue and Delmar Avenue, (74.95 acres), all of which is described herein (Proposal No. 2002Z-040U-10). Ms. Hausser moved to defer the bill to the May public hearing for a Planning Commission recommendation, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-556

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying the Neighborhood Conservation Overlay district to various properties located between Ferguson Avenue and Magnolia Boulevard and between 21st Avenue South and 12th Avenue South, in the Belmont-Hillsboro area, (180.08 acres), all of which is described herein (Proposal No. 2005Z-023U-10). The bill was approved by the Planning Commission. Ms. Hausser requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, citizens were heard in favor of and opposition to passage of the bill. The President declared the public hearing closed. Ms. Hausser moved to pass the bill on second reading and defer the bill to the first meeting in April, the bill being requested by the Metropolitan Historical Commission, which motion was seconded and adopted by a voice vote of the Council, with Mr. Greer voting "No".
