Metropolitan Council Meeting
Tuesday, January 15, 2002


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Brother Phil Barnes of the Hermitage Church of Christ.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of January 3, 2002 were approved.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

The Rules-Confirmations-Public Elections Committee recommended deferment of the following proposed amendment to Rule No. 23 of the Rules of Procedure of the Metropolitan Council:

Any resolution or proposed ordinance on introduction and first reading shall be deferred two meetings
if such resolution or proposed ordinance is not introduced or co-sponsored by the Council member from
the district concerned with the subject matter of such legislation. This provision shall not apply to zoning
measures introduced under Rule 9 or if the Council member from the district concerned declines to intro-
duce or co-sponsor such legislation.

Ms. Gilmore moved to defer action on the proposed rule change, which motion was seconded and adopted without objection.

- RESOLUTIONS-

RESOLUTION NO. RS2001-845

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and adopt legislation to provide for a sales tax on advertisements, including television, print, and outdoor advertisement. The Rules-Confirmations and Public Elections Committee recommended deferment of the resolution. Mr. Wallace moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2001-878

A resolution supplementing and amending Resolutions No. RS2001-510 and RS2001-786 of the Metropolitan County Council and awarding the sale of General Obligation Multi-Purpose Refunding Bonds, Series 2002A. The Budget and Finance Committee recommended deferment of the resolution. Mr. Shulman moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2002-917

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and support legislation that abolishes passage of the National Teacher Examination as a requirement for teacher licensing. The Education Committee recommended deferment of the resolution. Mr. Stanley moved to defer action on the resolution to the second meeting in February, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2002-918

A resolution requesting Gaylord Entertainment Company to continue its programming of country music on WSM-AM Radio. Mr. Lineweaver offered a substitute resolution and moved that it be accepted for filing and no objection was made.

A resolution expressing sympathy on the death of Metro Police Officer Joshua Haffner and encouraging donations to AmSouth Bank for benefit of his family. RESOLUTION NO. RS2002-920

A resolution appropriating one million seven hundred fifty thousand dollars ($1,750,000) from the Reserve for Council Infrastructure account of the General Services District to the Department of Public Works to fund drainage activities, street paving activities, and sidewalk construction and repairs. The resolution was approved by the Budget and Finance and Public Works Committees with amendments. Mr. Lineweaver offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 5810 and the related Local Government Investment Pool Agreement with the State of Tennessee, Department of Transportation, and Treasury Department, for Distribution and Collection System Relocations, said construction being necessary as part of State Project No. STP-M-24(8), 19041-2264-54, SR-24 (Lebanon Pike, US-70) Intersection with SR-255 (Donelson Pike), (Metro Project Nos. 99-SG-159 and 99-WG-144). A resolution authorizing the Nashville Convention Center to accept $8,888.75 from Christian Jubilee, Inc., in full and final satisfaction of Christian Jubilee, Inc. obligations under a June 20, 2000 lease agreement and the Letters of Commitment entered into with the Nashville Convention Center on March 23 and September 18, 1998; June 7, 1999; and June 10, 2000 for the use of Nashville Convention Center facilities in the years 2000 through 2005, inclusive. BILL NO. BL2002-945

An ordinance authorizing the acceptance of Contract No. 2001659 between the State of Tennessee and The Metropolitan Government of Nashville and Davidson County for LP 3349, Bridge over CSX Railroad (LM 1.57), on Chestnut Street. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2002-946

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Title 17 and Chapter 17.36 by deleting Article XII Urban Zoning Overlay District and the applicable provisions wherein they appear, all of which is more particularly described herein (Proposal No. 2002Z-001T). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2002-947

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.36.440 by deleting Council District 19 from the provisions of the Urban Zoning Overlay District, all of which is more particularly described herein (Proposal No. 2002Z-002T). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2001-875

An ordinance authorizing the placement of automatic teller machines (ATM's) in the Criminal Justice Center, Hermitage Police Precinct and South Police Precinct (Proposal No. 2001M-113U-09). The bill was approved by the Planning Commission, Budget and Finance, Public Safety-Beer, Wine and Whiskey and Planning, Zoning and Historical Committees. Mr. Waters moved to defer action indefinitely on the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-888

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL District to RM15 District properties at 7960 and 7978 Coley Davis Road, abutting the south margin of Coley Davis Road and the east margin of Somerset Farms Drive, (7.68 acres), all of which is more particularly described herein (Proposal No. 2001Z-105G-06). The bill was disapproved by the Planning Commission and the Planning, Zoning, and Historical Committee recommended deferment. Mr. Lineweaver moved to defer action indefinitely on the bill, awaiting further discussion with the developer, the bill being requested by Coley Davis One, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-889

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling the Commercial portion of the Residential and Commercial Planned Unit Development Districts located abutting the south margin of Coley Davis Road and the eastern margin of Scenic River Lane, classified CL District, (8.95 acres), proposed for RM15 on parcels 87 and 88, approved for a 175 unit motel, a 10,000 square foot restaurant and two office buildings totaling 55,000 square feet, all of which is more particularly described herein (Proposal No. 151-82-G-06). The bill was disapproved by the Planning Commission and the Planning, Zoning, and Historical Committee recommended deferment. Mr. Lineweaver moved to defer action indefinitely on the bill, awaiting further discussion with the developer, the bill being requested by Coley Davis One, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-890

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by closing an unbuilt portion of Oaklawn Avenue (Proposal No. 2001M-098U-10). Mr. Shulman offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. BILL NO. BL2001-894

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 District to CS District property at 5620 O'Brien Avenue, west of Midland Avenue (0.17 acres), (Proposal No. 2001Z-086U-07), all of which is more particularly described herein. The bill was disapproved by the Planning Commission and the Planning, Zoning, and Historical Committee recommended deferment. Mr. Ferrell, on behalf of the sponsor, moved to defer action on the bill, the bill being requested by Thomas Neely, which motion was seconded and adopted by a voice vote of the Council.

An ordinance amending the Metropolitan Code of Laws to permit the use of receptacles furnished by the Metropolitan Government in the collection of solid waste. The bill was approved by the Public Works Committee with an amendment. Ms. McClendon offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Ms. McClendon moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-926

An ordinance authorizing the acceptance of a donation of certain property (Tax Map 85, part of Parcel 1 - Heartland Drive) to The Metropolitan Government of Nashville and Davidson County, Tennessee, for the use and benefit of the Department of Parks and Recreation (Proposal No. 2001M-126G-14). The bill was approved by the Planning Commission, Budget and Finance, Parks, Library, Recreation and Auditorium and Planning, Zoning and Historical Committees. Mr. Loring moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-927

An ordinance approving a grant from the State of Tennessee, Department of State, to The Metropolitan Government of Nashville and Davidson County, acting through the Nashville Public Library, for funds to support library services to the blind and physically handicapped, materials for the disadvantaged, general library services and library services for the hearing impaired, for the period of October 1, 2001 to June 3, 2002. The bill was approved by the Budget and Finance and Parks, Library, Recreation and Auditorium Committees. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-928

An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring utility easements for use in public projects of the Metropolitan Government and specifically with relation to Project No. 01-WG-85, Hillsboro Road at Bancroft Place 8" Water Main. The bill was approved by the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-929

An ordinance abandoning a sewer line and easement on Map 106-0, Parcel 12, Project No. 01-SL-143, Margaret Allen School Sewer Line and Easement Abandonment (Proposal No. 2001M-108U-14). The bill was approved by the Planning Commission, Public Works, and Planning, Zoning and Historical Committees. Mr. Loring moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-930

An ordinance abandoning the sewer line and easement on Map 81-16, Parcel 143, 144, 145, and Map 81-12, Parcel 240, of Project No. 01-SG-154, Mt. Bethel Baptist Church Sewer Lines and Easement Abandonment. (Proposal No. 2001M-107U-08). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. BILL NO. BL2002-931

An ordinance requiring annual reports from the Metropolitan Department of Public Works to the Metropolitan Council on progress of implementation of the Metropolitan Government Solid Waste Plan. Ms. Hausser offered a substitute bill and moved that it be accepted for filing, and no objection was made.

SUBSTITUTE BILL NO. BL2002-931

A substitute ordinance requiring annual reports from the Metropolitan Department of Public Works to the Metropolitan Council on progress of implementation of the Metropolitan Government Waste Management Plan.
