RESOLUTION NO. RS2002-923

A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 5810 and the related Local Government Investment Pool Agreement with the State of Tennessee, Department of Transportation, and Treasury Department, for Distribution and Collection System Relocations, said construction being necessary as part of State Project No. STP-M-24(8), 19041-2264-54, SR-24 (Lebanon Pike, US-70) Intersection with SR-255 (Donelson Pike), (Metro Project Nos. 99-SG-159 and 99-WG-144).

WHEREAS, in order for the Tennessee Department of Transportation to construct State Project No. STP-M-24(8), 19041-2264-54, SR-24 (Lebanon Pike, US-70) Intersection with SR-255 (Donelson Pike); and

WHEREAS, the estimated cost for the water and sewer system relocation to the Department of Water and Sewerage Services is $299,608.11 of the total project cost; and

WHEREAS, the Tennessee Department of Transportation desires to start construction of said project and has submitted Utility Relocation Contract No. 5810; and

WHEREAS, the Metropolitan Government, by Ordinance No. 097-707, Section 2, is authorized to enter, by resolution, into Utility Relocation Contract No. 5810 with the Tennessee Department of Transportation; and

WHEREAS, the Metropolitan Government, by Ordinance No. 085-740, is authorized to enter, by resolution, into Local Government Investment Pool Agreements; and

WHEREAS, this work is identified in Metro's Capital Improvements Budget Nos. 96SG0005 and 96WG0005.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute Utility Relocation Contract No. 5810 with the Tennessee Department of Transportation (Exhibit A), made a part of this resolution by reference.

SECTION 2: That the Metropolitan Mayor is hereby authorized to execute a Local Government Investment Pool Agreement (Exhibit B) upon receipt of executed Contract No. 5810 from the State of Tennessee.

SECTION 3: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
