RESOLUTION NO. RS2002-928

A resolution authorizing the Metropolitan Department of Law to compromise and settle the lawsuit of Margaret Maddox against The Metropolitan Government of Nashville and Davidson County in the amount of $85,000.00.

Whereas, Ms. Margaret Maddox was the passenger in a van on County Hospital Road on June 27, 2000; and

Whereas, the Metropolitan Department of Public Works was performing milling operations along County Hospital Road prior to June 27, 2000; and

Whereas, the van punctured a tire after it ran over a gas valve box that had been exposed on the road; and

Whereas, the driver of the van lost control of the vehicle, and collided with an on-coming truck; and

Whereas, Ms. Maddox suffered severe and permanent injuries, as well as lost wages, as a result of this accident; and

Whereas, the Mr. Maddox filed a lawsuit against The Metropolitan Government of Nashville and Davidson County to recover for his damages; and

Whereas, the Metropolitan Department of Law believes that a settlement of one hundred thousand dollars ($85,000.00) is a fair and reasonable settlement and recommends that this claim be compromised and settled.

Now therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Margaret Maddox against the Metropolitan Government for the amount of one hundred thousand dollars ($85,000.00) and that said amounts should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
