The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Dee Jay Shoulders of First Apostolic Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Dear Vice Mayor Briley and Members of the Council:

Please find attached the State of Tennessee reporting form required to be submitted to the local legislative body following a sale of bonds. This report is for the sale of $455,540,000 General Obligation Bonds, Series 2017 authorized by the Metropolitan Council by Resolution No. RS2016-465. The bonds closed on February 2, 2017.

The bonds sold by competitive bid on January 24. The wining underwriter was Citigroup Global Markets, Inc. with a true interest cost of 3.153%.

As always, we appreciate the Metropolitan Council’s support on these important financing initiatives.

Solid Waste Region Board
Reappointment of Mr. Kenneth McMichael, Sr. for a term expiring December 15, 2022. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Vanessa Paz for a term expiring December 15, 2022. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

A resolution exempting Answer Restaurant located at 132 46th Avenue North, from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Ms. Murphy requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and a citizen was heard in favor of the resoltuion. The President declared the public hearing closed. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. Mr. Hastings requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The Public Safety, Beer, and Regulated Beverages Committee deferred by Rule. Mr. Hastings requested a suspension of the Rules to allow the resolution to be heard and no objection was made. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to IWD zoning for property located at 3920 Stewarts Lane, approximately 3,580 feet south of Ashland City Highway and partially located within the Floodplain Overlay District (10.0 acres), all of which is described herein (Proposal No. 2014Z-049PR-001). The bill was approved by Planning Commission. Mr. Leonardo moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-449

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to R6-A zoning on properties located at 123, 125, and 127 Cleveland Street and 904, 906, 908, 908B, 910, and 912 North 2nd Street, at the northwest corner of Cleveland Street and North 2nd Street (1.13 acres), all of which is described herein (Proposal No. 2016Z-119PR-001). Mr. Scott Davis moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to R6-A zoning on property located at 901 A Douglas Avenue, approximately 308 feet east of Cline Avenue, (0.33 acres), all of which is described herein (Proposal No. 2016Z-112PR-001). The bill was approved by the Planning Commission. Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2016-491

An ordinance amending Section 17.12.020 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to minimum glazing requirements in certain single and two-family residential zoning districts (Proposal No. 2016Z-025TX-001). The bill was disapproved by the Planning Commission. Ms. Dowell moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2016-493

An ordinance amending Chapters 17.04, 17.20 and 17.40 of the Metropolitan Code pertaining to sidewalks (Proposal No. 2016Z-024TX-001). Ms. Henderson moved to defer the bill to the March public hearing, which motion was seconded and approved by a voice vote of the Council.

An ordinance amending Title 15 and Title 17 of the Metropolitan Code of Laws pertaining to the Department of Water and Sewerage Services (Proposal No. 2016Z-022TX-001). The bill was approved by the Planning Commission with an amendment. Ms. Weiner moved to defer the bill to the March public hearing, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-543

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a Planned Unit Development Overlay for property located at 1497 Chadwell Drive (9.98 acres), approximately 400 feet southeast of Port Drive, zoned Multi-Family Residential (RM4), to permit the addition of 13 multi-family residential units for a maximum of 49 residential units within the overlay, all of which is described herein (Proposal No. 2004P-032-001). The bill was approved by the Planning Commission with conditions, disapproved without.

The bill was approved by the Planning Commission.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to RS10 zoning on various properties along Graybar Lane, southeast of the intersection of Granny White Pike and Draughon Avenue, (11.31 acres), all of which is described herein (Proposal No. 2017Z-013PR-001). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a Historical Landmark Overlay District on property located at 10611 Concord Road, approximately 600 feet southwest of Nolensville Pike, zoned AR2a (1.6 acres), all of which is described herein (Proposal No. 2017HL-001-001). The bill was approved by the Planning Commission. Mr. Swope moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a Planned Unit Development Overlay District on properties located at 2203, 2205 A and 2207 Pennington Bend Road, at the northwest corner of Pennington Bend Road and McGavock Pike, zoned OR20 (2.52 acres), all of which is described herein (Proposal No. 48-83P-002). The bill was approved by the Planning Commission.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 and RS40 to RS10 zoning on various properties along Clearview Drive, Crescent Road, Estes Road, Westmont Avenue and Woodmont Circle, located southwest of Wilson Boulevard and Woodlawn Drive, (approximately 39.53 acres), all of which is described herein (Proposal No. 2017Z-005PR-001). Ms. Murphy offered a second substitute ordinance and moved that it be accepted for filing, which motion was seconded and adopted by a voice vote of the Council.

SECOND SUBSTITUTE BILL NO. BL2017-555

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to RS10 zoning on various properties along Clearview Drive, Crescent Road, Estes Road, Westmont Avenue and Woodmont Circle, located southwest of Wilson Boulevard and Woodlawn Drive, (approximately 31.89 acres), all of which is described herein (Proposal No. 2017Z-005PR-001). Ms. Murphy moved to re-refer the bill to the Planning Commission and defer the bill to the March public hearing, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to MUL-A zoning on properties located at 1221 and 1223 Brick Church Pike, approximately 400 feet north of Fern Avenue, (0.25 acres), all of which is described herein (Proposal No. 2016Z-118PR-001).
