ORDINANCE NO. BL2017-582

An ordinance amending Chapter 2.24 of Title 2 of the Metropolitan Code of Laws regarding sales of public property.

WHEREAS, section 2.24.250.C.1 of the Metropolitan Code of Laws states that the director of public property is authorized to sell surplus property “with the approval of the metropolitan council”; and

WHEREAS, section 2.24.250.G of the Metropolitan Code of Laws allows the director of public property to execute an agreement to sell properties obtained by the Metropolitan Government through the delinquent tax-sale process, “subject to the prior approval of the metropolitan council by resolution”.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 2.24.210, “Public property – Leasing, rent collection, sale and disposal”, of the Code of The Metropolitan Government of Nashville and Davidson County is amended by deleting it in its entirety and substituting the following in lieu thereof:

2.24.210 - Public property—Leasing, rent collection, sale and disposal.

The director of public property administration shall be responsible for the leasing, collection of rent from leases of public property, sale and disposal of all public property of the metropolitan government where not otherwise provided by ordinance. Any sales or leases of public property shall be subject to the approval of the metropolitan council.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
