ORDINANCE NO. BL2017-590
An ordinance authorizing the acquisition of real property by negotiation or condemnation for the purpose of realigning the intersection of Hillsboro Road with Crestmoor Road and Glen Echo Road (Proposal No. 2017M-010PR-001).
WHEREAS, Section 2.01 of the Metropolitan Charter authorizes the Metropolitan Government to “lay out, open, extend, widen, narrow, establish or change the grade of, close, construct, pave, curb, gutter, adorn with shade trees, otherwise improve, maintain, repair, clean and light streets, roads, alleys and sidewalks”; and,
WHEREAS, Section 2.01 of the Metropolitan Charter further provides for the taking and appropriation of real property within the area of the Metropolitan Government for any public purpose when the public convenience requires it, and also for the purchase of real estate for any public purpose; and,
WHEREAS, public convenience requires acquisition of the fee simple interests described in Section 1 of this ordinance for the purpose of realigning the intersection of Hillsboro Road with Crestmoor Road and Glen Echo Road (the “Project”); and,
WHEREAS, the Project is identified as Project No. 16PW0015 “HILLSBORO PIKE AT CRESTMOOR ROAD - INTERSECTION REALIGNMENT AND IMPROVEMENTS - $7,000,000” in the Fiscal Year 2016-2017 Capital Improvements Budget approved by Ordinance No. BL2016-252.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
Section 1. The Project is declared to be in the interest of public convenience.
Section 2. The Director of Public Property Administration, or his designee, is authorized to acquire by negotiation or condemnation, in the name of the Metropolitan Government, fee simple interest in the parcels of property at 3715 Hillsboro Pike (Parcel ID 11711000600) and 3801 Hillsboro Pike (Parcel ID 11715000100), for use in undertaking the Project.
Section 3. The Director of Public Property Administration, or his designee, is hereby authorized to acquire by negotiation or condemnation such additional temporary construction easements as may be required for the construction of the Project.
Section 4. Any amendments to this ordinance may be approved by resolution of the Metropolitan Council.
Section 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:
I move to amend Ordinance No. BL2017-590 by deleting Section 2 in its entirety and substituting with the following:
Section 2. The Director of Public Property Administration, or his designee, is authorized to acquire by negotiation or condemnation, in the name of the Metropolitan Government, fee simple interest in the parcels of property at 2101 Crestmoor Road (Parcel ID 11710007500), 3715 Hillsboro Pike (Parcel ID 11711000600) and 3801 Hillsboro Pike (Parcel ID 11715000100), for use in undertaking the Project.
