ORDINANCE NO. BL2017-586
An ordinance amending Title 8.20 and Sections 8.20.050, 8.20.060, 8.20.100, 8.20.110, 8.20.120, 8.20.130, and 8.20.170 thereof regarding the application of animal control regulations beyond the Urban Services District.
WHEREAS, Title 8.20 of the Metropolitan Code of Laws provides animal control regulations within the Urban Services District of Nashville and Davidson County, Tennessee; and
WHEREAS, the relegation of animal control regulations to the Urban Services District in Title 8.20 of the Metropolitan Code of Laws (previously codified as section 8-2-1, then Code 1960, 4-22) dates back to the 1917 Nashville Code of Laws (sec. 1196) -- an era when Davidson County consisted of substantially more agricultural and farm land; and
WHEREAS, previous distinctions between the Urban Service District and General Services District, as it pertains to the application of animal control regulations, no longer make sense and do not reflect the current urban character of Davidson County.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT FOR NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Chapter 8.20 of the Metropolitan Code of Laws is hereby amended by deleting the reference to “URBAN SERVICE DISTRICT” therein and leaving only: “Chapter 8.20 ANIMAL CONTROL REGULATIONS”
Section 2. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “in the urban services district” in section 8.20.050 thereof.
Section 3. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “within the urban services district” in section 8.20.060.A thereof.
Section 4. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “in the urban services district” in section 8.20.100.A thereof.
Section 5. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “within the urban services district” in section 8.20.110 thereof.
Section 6. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “within the urban services district” in section 8.20.120 thereof.
Section 7. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “within the urban services district” in section 8.20.130 thereof.
Section 8. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “, within the urban services district” at the end of section 8.20.170 thereof.
Section 9. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2017-586
Mr. President –
I move to amend Ordinance No. BL2017-586 as follows:
I. By amending Section 4 by deleting it in its entirety.
Section 4. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “in the urban services district” in section 8.20.100.A thereof.
II. By amending Section 5 by deleting it in its entirety.
Section 5. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “within the urban services district” in section 8.20.110 thereof.
III. By amending Section 7 by deleting it in its entirety and renumbering the remaining sections as necessary.
Section 7. That Chapter 8.20 of the Metropolitan Code of Laws is hereby further amended by deleting the phrase “within the urban services district” in section 8.20.130 thereof.
