ORDINANCE NO. BL2017-560

An Ordinance amending Metropolitan Code of Laws Section 2.222.010(2)(o) regarding exemptions of items constituting “Anything of value”, and further amending Section 2.222.030 regarding annual benefit reporting statements disclosures.

WHEREAS, Section 2.222.010(2)(o) of the Metropolitan Code of Laws excludes from the definition of “Anything of value” food and/or beverages “that would not be prohibited under section 2.222.020(s)(2).” However, the reference to food and beverages is found in subsection 2.222.020(s)(1).

WHEREAS, Section 2.222.030.C.4 provides an Annual Benefit Reporting Statement form that includes the following provision: “b. For purposes of this report, the Employee is not required to list those items set forth in Section 2.222.030 C.1 and 2.”

WHEREAS, in the initial version introduced under Ordinance no. BL2007-1382, Section 2.222.030 C.1 and 2 referenced particular items such as “donations in connection with political campaigns” and “food and/or beverages of a nominal value”. In 2012, this section was amended per Ordinance no. BL2012-110, deleting these references and inserting, instead, formatting and signature instructions. However, the reference to the previous version of 2.222.030 C.1 and 2 was not removed from the Annual Benefit Reporting Statement form in Section 2.222.030.C.4.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 2.222.010(2)(o) of the Metropolitan Code is hereby amended by deleting the reference to 2.222.020(s)(2) therein and replacing it with 2.222.020(s)(1).

Section 2. That Section 2.222.030.C.4 of the Metropolitan Code is hereby amended by deleting the following sentence from the Annual Benefit Reporting Statement form therein:

“b. For purposes of this report, the Employee is not required to list those items set forth in Section 2.222.030 C.1 and 2.”

and renumbering the remaining sections as necessary.

Section 3. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
