ORDINANCE NO. BL2017-583

An ordinance amending Section 5.12.060 of the Metropolitan Code regarding dedication of a portion of transient occupancy privilege taxes generated by short term rental properties to the Barnes Fund for Affordable Housing.

WHEREAS, subsection 5.12.060.A(4) of the Metropolitan Code of Laws provides for a portion of transient occupancy privilege tax revenue, generated by short term rental properties as currently regulated under chapter 6.28, to be exclusively dedicated for appropriation to the Barnes Fund for Affordable Housing

WHEREAS, pending Ordinance No. BL2016-492, if enacted, would transfer short term rental property regulations from chapter 6.28 of the Metropolitan Code of Laws to Title 17; and

WHEREAS, if Ordinance No. BL2016-492 is enacted, the reference in section 5.12.060 to chapter 6.28, as it pertains to short term rental property regulation, shall require revision.

THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 5.12.060 of the Metropolitan Code is hereby amended by deleting the reference in subsection A(4) to “chapter 6.28” and substituting in lieu thereof: “Title 17”.

Section 2. That this Ordinance shall take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
