ORDINANCE NO. BL2017-541

An ordinance amending section 2.20.130 of the Metropolitan Code of Laws regarding appointment of special advisory committees to propose persons to serve as administrative hearings officers.

WHEREAS, on June 22, 2011, the Metropolitan Council enacted Ordinance no. BL2011-912, codified in section 2.20.130 of the Metropolitan Code of Laws, which established Metropolitan administrative hearing officers to hear building and property maintenance code violations, as authorized under Tenn. Code Ann. § 6-54-1001, et seq.; and

WHEREAS, a small typographical error appeared in Ordinance no. BL2011-912, and consequently in section 2.20.130 of the Metropolitan Code, inadvertently omitting the word “not” from the final sentence thereof.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. That section 2.20.130 of the Metropolitan Code is hereby amended by deleting subsection F in its entirety and substituting the following in lieu thereof:

F. The vice-mayor shall appoint a special advisory committee to submit a list of persons to the metropolitan council that the committee deems best qualified to serve as administrative hearing officers. The special advisory committee shall include, but does not have to be limited to, the following:
1. The Director of the Department of Codes Administration or his/her designee;
2. The Director of Law or his/her designee; and
3. The Chair of the Council Codes, Fair, and Farmers Market Committee.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
