ORDINANCE NO. BL2017-565

An ordinance approving a participation agreement between the Metropolitan Government and Century Farms LLC, for the construction of public infrastructure improvements, phases PE-N and PE-D (Proposal No. 2017M-004PR-001).

WHEREAS, Ordinance BL2016-430 approved a participation agreement between Century Farms LLC and The Metropolitan Government of Nashville and Davidson County, (“Metro”) for the construction of public infrastructure improvements; and

WHEREAS, to continue forward with this application for state and federal funds, pursuant to Agreement Number 160100 with the State of Tennessee, Metro must agree to cover 100 percent of the costs associated with the first two phases of this construction project, PE-N and PE-D; and

WHEREAS, Century Farms has agreed to pay the estimated costs associated with phase PE-N and PE-D, which will be $65,000 and $1,940,000, respectively; and,

WHEREAS, the parties would like to enter into the participation agreement attached hereto for phases PE-N and PE-D; and,

WHEREAS, the completion of the Project and the provision of such public infrastructure improvements will benefit both parties and the general community of Nashville and Davidson County, Tennessee.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement between the Metropolitan Government and Century Farms, for Phases PE-N and PE-D, attached hereto and incorporated herein by reference, is hereby approved, and the Director of Public Works, or his designee, is authorized to execute the same.

SECTION 2. Future amendments to this agreement shall be approved by resolution of the Metropolitan Council.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
