ORDINANCE NO. BL2017-568

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sanitary sewer main and easement and to accept a new sanitary sewer main and easement, and sanitary sewer manholes, for properties located at 415 27th Avenue North and 512 26th Avenue North (MWS Project No. 16-SL-197 and Proposal No. 2017M-005ES-001).

WHEREAS, the abandonment of approximately 183 feet of existing eight inch sanitary sewer main and easement and the acceptance of approximately 334 linear feet of new 10 inch sanitary sewer main and easement, and five sanitary sewer manholes, for properties located at 415 27th Avenue North and 512 26th Avenue North, are needed to construct project number 16-SL-197 and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-005ES-001 on November 28, 2016, for the abandonment and acceptance of said sanitary sewer mains, manholes and easements;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 183 feet of existing eight inch sanitary sewer main and easement and to accept approximately 334 linear feet of new 10 inch sanitary sewer main and easement, and five sanitary sewer manholes for properties, located at 415 27th Avenue North and 512 26th Avenue North, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
