ORDINANCE NO. BL2017-569

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and easements and to accept new sewer main, manholes and easements for properties located at 112, 114 and 118 7th Avenue North (MWS Project No. 16-SL-158 and Proposal No. 2017M-006ES-001).

WHEREAS, the abandonment of approximately 195 linear feet of an existing 18 inch sewer main and easement and the acceptance of approximately 207 linear feet of new 18 inch sewer main and easement, and three sewer manholes, for properties located at 112, 114, and 118 7th Avenue North, are needed to construct project number 16-SL-158; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-006ES-001 on November 28, 2016, for the abandonment and acceptance of said sewer mains, three sewer manholes and easements;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 195 linear feet of an existing 18 inch sewer main and easement and to accept approximately 207 linear feet of new 18 inch sewer main and easement, and three sewer manholes, for properties located at 112, 114 and 118 7th Avenue North, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
