ORDINANCE NO. BL2017-562

An ordinance approving the First Amendment to the Lease Agreement by and between The Metropolitan Government of Nashville and Davidson County and Steven M. Minton and Elaine Minton (Proposal No. 2017M-001PR-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County (“Lessee”) and Steve M. Minton and Elaine Minton (“Lessor”) are parties to a Lease Agreement dated August 9, 1998 (the “Lease”) for a portion of the property located on Greer Road, Joelton TN as authorized by O98-1362 and more fully described in Exhibit A, attached hereto and incorporated herein by reference (the “Lease”); and,

WHEREAS, Lessor agrees to permit Metro use of the Leased Premises for the purpose of a 800MHZ Emergency Communications Tower; and,

WHEREAS, the parties desire to amend said Lease by adding the addition covenants described in the First Amendment, attached hereto as Exhibit B ; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that amendment one be accepted.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That this Amendment to the Lease entered into between Metropolitan Government of Nashville and Davidson County and Steve M. Minton and Elaine Minton, a copy of which is attached hereto as Exhibit B and incorporated herein, is hereby approved, and the Director of Public Property is authorized to execute the same.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
