ORDINANCE NO. BL2016-496
An Ordinance amending Section 12.40.040 of the Metropolitan Code to prohibit non-electric vehicles from parking in electric vehicle charging stations.
BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Chapter 12.40.040 of the Metropolitan Code is hereby amended by adding the following subsection:
F. No vehicle shall be parked in a space designated for charging any electric vehicle by any sign or pavement marking using the term "electric vehicle charging," or otherwise reasonably indicating designation for electric vehicle charging, unless the vehicle is a plug-in electric vehicle. As used in this section, “plug-in electric vehicle” shall mean any motor vehicle that draws electricity from a battery that is capable of being charged from an external source. The owner of any motor vehicle found in violation of this subsection shall be subject to a fine in the amount of fifty dollars, which shall be assessed by the issuance of a parking citation.
Section 2. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2016-496
Mr. President –
I move to amend Ordinance No. BL2016-496 as follows:
I. By amending Section 1 by deleting it in its entirety and substituting therefore the following:
Section 1. That Chapter 12.40.040 of the Metropolitan Code is hereby amended by adding the following subsection:
F. In parking lots with designated spaces for ten (10) or more vehicles, no vehicle shall be parked in a space designated for charging any electric vehicle by any sign or pavement marking using the term "electric vehicle charging," or otherwise reasonably indicating designation for electric vehicle charging, unless the vehicle is a plug-in electric vehicle. The owner of any motor vehicle found in violation of this subsection shall be subject to a fine in the amount of fifty dollars, which shall be assessed by the issuance of a parking citation. In spaces designated for charging an electric vehicle on property owned by the Metropolitan Government of Nashville and Davidson County, such spaces shall be marked with official signs or pavement markings to prohibit parking of any vehicle other than plug-in electric vehicles. On or before January 1, 2018, any space designated for charging electric vehicles in parking lots with designated spaces for ten (10) or more vehicles must be marked by a sign, pavement marking or other indication that parking of non-electric vehicles in such space is prohibited. As used in this section, “plug-in electric vehicle” shall mean any motor vehicle that draws electricity from a battery that is capable of being charged from an external source.
