Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Rabbi Philip “Flip” Rice of Congregation Micah.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of November 1, 2016 were approved.

- ELECTIONS AND CONFIRMATIONS -

Community Education Commission
The President announced that two nominations were received by the Metropolitan Clerk today for vacancies on the Community Education Commission. Mr. Swope nominated Dr. Edward Hantel and Ms. Murphy nominated Mr. Bernard Pickney. Nominees are referred to the Rules, Confirmations, and Public Elections Committee for a recommendation, and an election will be conducted at the December 6, 2016 meeting of the Council.

Community Corrections Advisory Board
Appointment of Mr. Lonnell Matthews, Jr. for a term expiring August 31, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Kevin R. McGee for a term expiring August 18, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Emergency Communications District Board
Appointment of Ms. Lorinda Hale for a term expiring February 14, 2020. Ms. Hale will fill the unexpired term of Mr. James Buford Tune. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Sexually Oriented Business Licensing Board
Reappointment of Mr. Cullen Earnest for a term expiring October 7, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a voice vote of the Council with Mr. Sledge and Ms. Weiner abstaining.

- RESOLUTIONS ON PUBLIC HEARING-

RESOLUTION NO. RS2016-432

A resolution exempting TBLS, LLC/TKO located at 4204 Gallatin Road, from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. Anthony Davis requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The Public Safety, Beer, and Regulated Beverages Committee recommended deferment. Mr. Davis requested a suspension of the rules to allow the resolution to be adopted and no objection was made. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-397

A resolution exempting 5th and Taylor, LLC located at 1411 Fifth Avenue North, from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee.

RESOLUTION NO. RS2016-434

A resolution authorizing an economic and community development incentive grant to be made to The Industrial Development Board of The Metropolitan Government of Nashville and Davidson County for the benefit of Warner Music, Inc. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-436

A resolution approving a contract between the Metropolitan Government of Nashville and Davidson County and Sungard Availability Services to provide disaster recovery and business continuity solutions for the Metropolitan Department of Information Technology Services. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-437

A resolution accepting a grant from the State of Tennessee, Administrative Office of the Courts, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, for the provision of interpreter/translation services for court hearings which involve individuals with limited English proficiency. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-438

A resolution accepting a grant from the Comcast Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Finance Department, in gratitude for the participation of Metropolitan employees in the 15th annual Comcast Cares Day to improve our communities by painting and cleaning schools, landscaping public gardens, stocking food banks, and other services to make a positive difference in the community. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-440

A resolution approving Amendment Two to a grant from the U. S. Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Family Safety, to enable the implementation of a county-wide risk/lethality program, to create and implement a civil/legal advocacy program for order of protection hearings, and to improve the substance and quality of presentations. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-441

A resolution approving an intergovernmental agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police Department, and the City of Cookeville, acting by and through the Cookeville Police Department, for the distribution of state grant funds to assist with investigations of internet crimes against children. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-442

A resolution approving an intergovernmental agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police Department, and Dickson County, acting by and through the Dickson County Sheriff’s Office, for the distribution of state grant funds to assist with investigations of internet crimes against children. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-443

A resolution approving an intergovernmental agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police Department, and the City of Spring Hill, acting by and through the Spring Hill Police Department, for the distribution of state grant funds to assist with investigations of internet crimes against children. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-444

A resolution approving an intergovernmental agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police Department, and the Tennessee Association of Chiefs of Police, for the distribution of state grant funds to assist with investigations of internet crimes against children. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-445

A resolution approving a data sharing agreement between the State of Tennessee Department of Correction and the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee.

RESOLUTION NO. RS2016-446

A resolution approving a sub-recipient grant agreement by and between the Metropolitan Development and Housing Agency (MDHA) and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Social Services/Metropolitan Homelessness Commission, to provide services for homelessness persons housed through the 100,000 Homes Campaign and to provide outreach to persons living in encampments. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-447

A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the State of Tennessee, Department of Agriculture, to assist in conducting retail food store inspections under the Tennessee Retail Food Safety Act. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-448

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to implement and coordinate activities and services related to HIV/AIDS/STD and Viral Hepatitis prevention, testing, diagnosis and treatment, and surveillance. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-449

A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and World Relief to operate a mobile unit to provide services to current and potential Women Infants & Children (WIC) Program recipients. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-450

A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Matthews Memorial United Methodist Church to operate a mobile unit to provide services to current and potential Women Infants & Children (WIC) Program recipients. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-451

A resolution approving an Interlocal Agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, and the Nolensville College Grove Utility District of Williamson County, for the transfer of a service area in Williamson County. The resolution was approved by the Public Works Committee.

RESOLUTION NO. RS2016-452

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for a General Maintenance Agreement for pavement markings and signs, PIN 121627.00. The resolution was approved by the Public Works Committee.

RESOLUTION NO. RS2016-454

A resolution authorizing Mike’s Ice Cream, LLC to construct and install an aerial encroachment at 129 2nd Ave North for (Proposal No.2016M-034EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.

RESOLUTION NO. RS2016-455

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Jewell Harris against the Metropolitan Government of Nashville and Davidson County in the amount of $11,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-456

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Mary A. Stumptner against the Metropolitan Government of Nashville and Davidson County in the amount of $54,275.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-458

A resolution expressing the Metropolitan Council’s support for the inclusion of recent revisions to Section 10.56.020 of the Metropolitan Code of Laws into the State Implementation Plan and requesting that the State of Tennessee Air Pollution Control Division (APCD) adopt such revisions. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-461

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-406

A resolution allowing exemption of motor vehicles registered in Davidson County that are three (3) or less model years old from the required vehicle inspection and maintenance program to attain or maintain compliance with national ambient air standards. The Health, Hospitals, and Social Services Committee recommended deferment. Mr. Pulley moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-435

A resolution authorizing the Metropolitan Development and Housing Agency to negotiate and enter into a PILOT Agreement and accept payments in lieu of ad valorem taxes with respect to a multi-family housing project located at 5646 Old Hickory Boulevard, known as Hermitage Flats. The Budget and Finance Committee recommended deferment. Mr. Cooper moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-439

A resolution accepting a donation from Hospital Corporation of America (HCA) to the Metropolitan Government of Nashville and Davidson County for the use and benefit of the Office of Family Safety. The resolution was approved by the Budget and Finance Committee; the Public Safety, Beer, and Regulated Beverages Committee approved the resolution with an amendment. Mr. Cooper offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2016-453

A resolution to amend Ordinance No. BL2014-784 to add one additional parcel located at 437 36th Avenue North to the negotiation and acceptance of permanent and temporary easements for construction of the I-40/I-440 South Sewer Relocation Project (Project No. 13-SG-0129 and Proposal No. 2014M-010ES-002). The resolution was approved by the Planning and Zoning Committee; the Public Works Committee recommended withdrawal at the recommendation of the administration. Ms. Murphy moved to withdraw the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-457

A resolution requesting that the Metro Nashville Network place for airing, on a regular basis and at regular intervals, the agendas for upcoming meetings of the Metro Council. The Rules, Confirmations, and Public Elections Committee recommended deferment. Mr. Shulman moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-459

A resolution requesting that the Metropolitan Nashville Police Department inform the Metropolitan Council whether they agree or disagree with research findings in a recent report from Gideon’s Army regarding MNPD traffic stop statistics in Nashville, and to further provide any other statistics or information necessary to refute, confirm, or add context to this report. The Public Safety, Beer, and Regulated Beverages Committee recommended deferment. Mr. Mendes moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-460

A resolution requesting that Mayor Megan Barry obtain and make public an independent assessment and valuation of the current redevelopment construction plans for the National Museum of African American Music at the former Nashville Convention Center; further requesting that, if independent assessment and valuation shows current redevelopment and construction plans for said Museum have a value less than that presented to the Metropolitan Council in 2015, the developer should reimburse the underage, and that if the location of the Museum be found not in compliance with what was presented in 2015, the location should be moved to be in compliance; and further requesting that the Convention Center Authority of the Metropolitan Government participate in public hearings before the Metropolitan Council regarding the final location, design and redevelopment plans for the Museum. The Convention, Tourism and Public Entertainment Facilities recommended deferment; the Rules, Confirmations, and Public Elections Committee recommended deferment and requested the resolution be referred to the Budget and Finance Committee. Ms. Gilmore moved to defer the resolution, refer it to the Budget and Finance Committee, and re-refer it to the Convention, Tourism and Public Entertainment Facilities and Rules, Confirmations, and Public Elections Committees, which motion was seconded. After discussion, Mr. Pridemore called for the previous question, which motion was seconded and adopted by a voice vote of the Council. The matter recurred to the motion to defer and refer to committees as outlined and was approved by a voice vote of the Council.

- BILLS ON INTRODUCTION AND FIRST READING -

BILL NO. BL2016-483

An ordinance amending section 2.44.115 of the Metropolitan Code of Laws to require the Metropolitan Police Department to provide traffic stop reports to the Metropolitan Council. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety, Beer, and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2016-484

An ordinance making applicable to Metropolitan Government the provisions of Part 7 of Chapter 211 of Title 68 of the Tennessee Code Annotated to require local approval of landfills, solid waste disposal facilities and solid waste processing facilities prior to the construction of such facilities. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works Committee by a voice vote of the Council.

BILL NO. BL2016-485

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water main and any associated easements and to accept new sanitary sewer and water mains and any associated easements, sanitary sewer manholes and fire hydrants for property located at 0 Ashland City Highway (MWS Project No. 16-WL-75 and 16-SL-60 and Proposal No. 2016M-054ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-486

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion 13th Avenue South right-of-way and easement (Proposal Number 2016M-021AB-001). The bill was approved by the Planning Commission and Traffic and Parking Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical, Public Works and Traffic, Parking and Transportation Committees by a voice vote of the Council.

BILL NO. BL2016-487

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning on property located at 2007 23rd Avenue North, at the southwest corner of Lacy Street and 23rd Avenue North, (0.52 acres), to permit up to seven residential units, all of which is described herein (Proposal No. 2016SP-079-001). The bill was approved by the Planning Commission with conditions, disapproved without. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-488

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD to MUL-A zoning for property located at 1267 2nd Avenue South, at the northwest corner of Hart Street and 2nd Avenue South (0.14 acres), all of which is described herein (Proposal No. 2016Z-094PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-489

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD to MUL-A zoning for properties located at 1277 and 1285 2nd Avenue South, at the southwest corner of Hart Street and 2nd Avenue South (0.34 acres), all of which is described herein (Proposal No. 2016Z-095PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-490

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to MUL-A zoning on property located at 2709 Clifton Avenue, approximately 280 feet southeast of 28th Avenue North, (0.23 acres), all of which is described herein (Proposal No. 2016Z-114PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

An ordinance amending Section 17.12.020 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to minimum glazing requirements in certain single and two-family residential zoning districts (Proposal No. 2016Z-025TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-492

An ordinance to amend Titles 6 and 17 of the Metropolitan Code, Zoning Regulations, pertaining to Short Term Rental Properties (Proposal No. 2016Z-023TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Codes, Fair, and Farmers Market, Convention, Tourism, and Public Entertainment Facilities, and Planning, Zoning, and Historical Committees by a voice vote of the Council.

BILL NO. BL2016-493

An ordinance amending Chapters 17.04, 17.20 and 17.40 of the Metropolitan Code pertaining to sidewalks (Proposal No. 2016Z-024TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees by a voice vote of the Council.

Vice Mayor Briley entertained a motion to rescind the previous action on BL2016-493, which was seconded and approved by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2016-493

An ordinance amending Chapters 17.04, 17.20 and 17.40 of the Metropolitan Code pertaining to sidewalks (Proposal No. 2016Z-024TX-001). Ms. Henderson offered a substitute ordinance and moved that it be accepted for filing, which motion was seconded and adopted by a voice vote of the Council. The bill passed first reading as substituted and was referred to the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees by a voice vote of the Council.

- BILLS ON SECOND READING -

SUBSTITUTE BILL NO. BL2016-381

An ordinance to amend Chapter 6.28 of the Metropolitan Code pertaining to Short Term Rental Property (STRP). The Codes, Fair, and Farmers Market and Convention, Tourism, and Public Entertainment Facilities Committees approved the bill with an amendment. Ms. Allen offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council with Ms. Roberts abstaining. Ms. Allen moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council with Ms. Roberts abstaining.

The bill was approved by the Planning Commission with conditions, disapproved without. The Planning, Zoning, and Historical Committee approved an amendment to the bill and recommended deferment. Mr. O’Connell offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. O’Connell moved to defer the bill as amended, which motion was seconded and approved by a voice vote of the Council.
