RESOLUTION NO. RS2016-451

A resolution approving an Interlocal Agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, and the Nolensville College Grove Utility District of Williamson County, for the transfer of a service area in Williamson County.

WHEREAS, Resolution 2007-2016 approved an Intergovernmental Agreement between The Metropolitan Government of Nashville and Davidson County (“Metro”) and the Nolensville College Grove Utility District of Williamson County (“Utility District”), wherein Metro agreed to serve the McFarlin PUD Development (“Development”), in Williamson County, due to a concern that Utility District could not service the Development and continue to provide water service demanded by its current customers; and,

WHEREAS, Utility District now has the ability to assume the service area transferred to Metro, identified as parcel 001.01 on Williamson County Tax Map 57, and wishes to assume service of the Development; and,

WHEREAS, Metro desires to transfer the service of the Development to Utility District; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement amendment be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Interlocal Agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, and the Nolensville College Grove Utility District of Williamson County, for the transfer of a service area in Williamson County, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
