ORDINANCE NO. BL2016-464

An ordinance approving a contract with Nature’s Best Organics of Tennessee, LLC to provide all labor, equipment, materials and supplies for the receiving, processing, disposal and composting of all yard waste and vegetative storm debris collected by or on behalf of The Metropolitan Government of Nashville and Davidson County, as part of routine collection and major storm events.

WHEREAS, pursuant to Section 2.01 of the Metropolitan Charter, the Metropolitan Government has the authority to collect and dispose of garbage and other refuse; and,

WHEREAS, pursuant to its authority under Section 2.01 of the Metropolitan Charter and the terms of the contract (“Contract”) attached hereto as Exhibit A, the Metropolitan Government of Nashville and Davidson County (“Metro”) proposes to contract with Nature’s Best Organics of Tennessee, LLC to provide all labor, equipment, materials and supplies for the receiving, processing, disposal and composting of all yard waste and vegetative storm debris collected by or on behalf of Metro as part of routine collection and major storm events; and,

WHEREAS, the proposed contract term is ten (10) years; and,

WHEREAS, approval of the Contract will benefit the citizens of Davidson County by providing an economical and efficient means of disposing of yard waste.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Contract between The Metropolitan Government of Nashville and Davidson County and Nature’s Best Organics of Tennessee, LLC, attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute said contract.

Section 2. Any amendments, renewals, or extension of the terms of the Agreement must be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
