RESOLUTION NO. RS2016-406

A resolution allowing exemption of motor vehicles registered in Davidson County that are three (3) or less model years old from the required vehicle inspection and maintenance program to attain or maintain compliance with national ambient air standards.

WHEREAS, Public Chapter 1028 adopted by the General Assembly of the State of Tennessee on April 21, 2016 authorizes counties to exempt motor vehicles three (3) model years or less old from their required inspection and maintenance program to attain or maintain compliance with national ambient air standards provided a resolution is adopted by the county legislative body approving the exemption on or before December 31, 2016; and

WHEREAS, the presiding officer of the governing body must submit a certified copy of the resolution to the Technical Secretary of the Air Pollution Board of the State of Tennessee no later than January 31, 2017; and

WHEREAS, currently motor vehicles that are one (1) model year or less old are exempt from the emissions testing; and

WHEREAS, the exemption will not become effective until the State Implementation Plan has been revised and approved by the federal Environmental Protection Agency (EPA) and after the expiration or revision of any contract in effect with the contractor currently conducting the motor vehicle emissions testing for Metropolitan Government as of the date of EPA approval.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Motor vehicles registered in Davidson County that are three (3) or less model years old shall be exempt from the required vehicle inspection and maintenance program to attain or maintain compliance with national ambient air standards.

Section 2. The Vice Mayor as presiding officer of the Council of The Metropolitan Government of Nashville and Davidson County shall submit a certified copy of the resolution to the Technical Secretary of the Air Pollution Board of the State of Tennessee no later than January 31, 2017.

Section 3. Pursuant to T.C.A. 55-4-130 (h) (2), the exemption provided in this resolution will not become effective until the State Implementation Plan has been revised and approved by the federal Environmental Protection Agency (EPA) and after the expiration or revision of any contract in effect with the contractor currently conducting the motor vehicle emissions testing for Metropolitan Government as of the date of EPA approval.

Section 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
