ORDINANCE NO. BL2016-457

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer and water main and sanitary manhole and to accept new sanitary manholes and any associated easements for properties located at 1 University Park Drive and 3704 Rosemont Avenue (MWS Project No. 16-WL-143 and 16-SL-161 and Proposal No. 2016M-046ES-001).

WHEREAS, the abandonment of approximately 114 linear feet of existing eight inch sanitary sewer main, one sanitary sewer manhole, approximately 104 linear feet of existing six inch water main, and acceptance of sanitary manholes and any associated easements for properties located at 1 University Park Drive and 3704 Rosemont Avenue are needed to construct Project No. 16-WL-143 and 16-SL-161 and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-046ES-001 on September 13, 2016, for the abandonment and acceptance of said sewer and water main and manholes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 114 linear feet of existing eight inch sanitary sewer main, one sanitary sewer manhole, approximately 104 linear feet of existing six inch water main, and acceptance of sanitary manholes and any associated easements for properties located at 1 University Park Drive and 3704 Rosemont Avenue as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
