ORDINANCE NO. BL2016-458

An ordinance approving amendment one to the Ground Lease for Rose Park between The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Parks and Recreation, and Belmont University (Proposal No. 2016M-019PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“Metro”) owns and through the Department of Parks and Recreation (“Parks”) operates Rose Park; and,

WHEREAS, Metro and Belmont University (“Belmont”) are parties to the Lease dated November 5, 2007, as authorized by BL2007-1544 attached hereto and incorporated herein by reference (the “Lease”); and,

WHEREAS, Section 3.a of said Lease requires that twenty percent (20%) of the lease payment by Belmont be allocated and evenly distributed to the parent teacher organizations (PTOs) of Carter Lawrence and Rose Park public schools; and,

WHEREAS, the parties desire to amend said Lease by changing the language of Section 3.a of the lease to state that twenty percent (20%) of the lease payment by Belmont be allocated and evenly distributed to Carter Lawrence and Rose Park public schools; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that amendment one be accepted.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment One to the Lease entered into between The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Parks and Recreation, and Belmont University, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Director of Public Property is authorized to execute the same.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
